| 12 | 5 | | relating to the qualifications for appointment as a veterans county |

| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Section 434.033(b), Government Code, is amended |
|---|
| 16 | 9 | | to read as follows: |
|---|
| 17 | 10 | | (b) To be appointed as an officer a person must: |
|---|
| 18 | 11 | | (1) be qualified by education and training for the |
|---|
| 19 | 12 | | duties of the office; |
|---|
| 20 | 13 | | (2) be experienced in the law, regulations, and |
|---|
| 21 | 14 | | rulings of the United States Department of Veterans Affairs |
|---|
| 22 | 15 | | controlling cases that come before the commission; and |
|---|
| 23 | 16 | | (3) have the service experience specified by |
|---|
| 24 | 17 | | Subsection (c) or be: |
|---|
| 25 | 18 | | (A) a widowed Gold Star Mother or unremarried |
|---|
| 26 | 19 | | widow of a serviceman or veteran whose death resulted from service; |
|---|
| 27 | 20 | | [or] |
|---|
| 28 | 21 | | (B) the spouse of a disabled veteran who has a |
|---|
| 29 | 22 | | total disability rating based either on having a service-connected |
|---|
| 30 | 23 | | disability with a disability rating of 100 percent or on individual |
|---|
| 31 | 24 | | unemployability; or |
|---|
| 32 | 25 | | (C) the spouse of a retired veteran who served a |
|---|
| 33 | 26 | | minimum of 20 years on active duty. |

| 34 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 35 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 31 | | Act takes effect September 1, 2015. |
