108 relating to the regulation of raw milk and raw milk products; adding
119 a provision subject to a criminal penalty.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter A, Chapter 435, Health and Safety
1412 Code, is amended by adding Sections 435.0061, 435.0062, and
1513 435.0063 to read as follows:
1614 Sec. 435.0061. RAW MILK AND RAW MILK PRODUCTS FOR RETAIL
1715 SALE. (a) This section does not authorize the sale of:
1816 (1) raw milk or raw milk products to or on the premises
1917 of a grocery store, supermarket, or similar retail market;
2018 (2) raw milk or raw milk products that are a blend of
2119 raw milk purchased from more than one holder of a permit issued
2220 under this chapter; or
2321 (3) raw milk or raw milk products by a person other
2422 than the permit holder.
2523 (b) Except as provided by Section 435.013, a person who
2624 holds a permit that authorizes the person to sell raw milk or raw
2725 milk products at retail may make retail sales of raw milk or raw
2826 milk products directly to a consumer in this state at:
2927 (1) the permit holder's place of business;
3028 (2) the consumer's residence; or
3129 (3) a farmers' market as defined by Section 437.020.
3230 (c) Raw milk and raw milk products must be maintained in
3331 compliance with Section 435.0063.
3432 (d) A person who sells raw milk or raw milk products under
3533 this section shall affix to individual raw milk or raw milk product
3634 containers a label that includes:
3735 (1) the name of the permit holder;
3836 (2) the permit holder's permit number;
3937 (3) the calendar date the raw milk or raw milk product
4038 was packaged in the container; and
4139 (4) the following statement: "This product contains
4240 unpasteurized milk. Consuming raw foods, including raw dairy
4341 products, may increase your risk of food-borne illness. Persons at
4442 higher risk for food-borne illness include pregnant and nursing
4543 women, children, the elderly, and people with weakened immune
4644 systems."
4745 Sec. 435.0062. AVAILABILITY OF RECORDS ON RAW MILK TESTING.
4846 On request, the department shall provide the requestor with a
4947 record of test results from an inspection of raw milk or raw milk
5048 products conducted under Section 435.004 or 435.005.
5149 Sec. 435.0063. STORING, HANDLING, AND TRANSPORTING RAW MILK
5250 AND RAW MILK PRODUCTS FOR RETAIL SALE. (a) The executive
5351 commissioner shall adopt rules for the safe storing, handling, and
5452 transporting of raw milk and raw milk products produced for sale
5553 under Section 435.0061.
5654 (b) Raw milk and raw milk products produced for retail sale
5755 under this chapter must be placed in a sterile or single-use
5856 container and sold not later than the fifth day after the date the
5957 container was filled.
6058 (c) Raw milk and raw milk products being transported for
6159 delivery must be:
6260 (1) maintained in air temperatures at or below 45
6361 degrees Fahrenheit at all times except during transfer from one
6462 storage area or transportation vehicle to another; and
6563 (2) protected from exposure to direct sunlight.
6664 (d) The department or a local health authority may not
6765 mandate the specific method for complying with a temperature
6866 requirement.
6967 (e) A producer may contract with another person to transport
7068 and deliver raw milk and raw milk products in accordance with this
7169 section. The producer is jointly and severally liable for
7270 transport and delivery of raw milk and raw milk products not
7371 conducted in accordance with this chapter and department rules.
7472 SECTION 2. This Act takes effect September 1, 2015.
