| 7 | 7 | | relating to the dismissal of protests against certain decisions and |

| 8 | 8 | | actions of the Texas Commission on Environmental Quality regarding |

| 9 | 9 | | wastewater discharge permits. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
|---|
| 12 | 12 | | by adding Section 26.0284 to read as follows: |
|---|
| 13 | 13 | | Sec. 26.0284. DISMISSAL OF CERTAIN PROTESTS. (a) In this |
|---|
| 14 | 14 | | section, "protest" means: |
|---|
| 15 | 15 | | (1) a request that the commission hold a contested |
|---|
| 16 | 16 | | case hearing on an application for a wastewater discharge permit; |
|---|
| 17 | 17 | | (2) a request that the commission reconsider the |
|---|
| 18 | 18 | | executive director's decision to issue a wastewater discharge |
|---|
| 19 | 19 | | permit; |
|---|
| 20 | 20 | | (3) a motion requesting that the commission overturn |
|---|
| 21 | 21 | | the executive director's issuance of a wastewater discharge permit; |
|---|
| 22 | 22 | | or |
|---|
| 23 | 23 | | (4) a motion requesting that the commission review its |
|---|
| 24 | 24 | | decision denying a request for a contested case hearing on an |
|---|
| 25 | 25 | | application for a wastewater discharge permit or approving an |
|---|
| 26 | 26 | | application for a wastewater discharge permit after a contested |
|---|
| 27 | 27 | | case hearing has been conducted. |
|---|
| 28 | 28 | | (b) The commission shall dismiss a protest if the protest is |
|---|
| 29 | 29 | | filed by a municipality that is subject to less stringent |
|---|
| 30 | 30 | | wastewater treatment requirements than the requirements |
|---|
| 31 | 31 | | established by the permit. |
|---|
| 32 | 32 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 33 | 33 | | a request or motion filed with the Texas Commission on |
|---|
| 34 | 34 | | Environmental Quality on or after the effective date of this Act. A |
|---|
| 35 | 35 | | request or motion filed before the effective date of this Act is |
|---|
| 36 | 36 | | governed by the law in effect on the date the request or motion was |
|---|
| 37 | 37 | | filed, and the former law is continued in effect for that purpose. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2015. |
