55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the dismissal of protests against certain decisions and
88 actions of the Texas Commission on Environmental Quality regarding
99 wastewater discharge permits.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
1212 by adding Section 26.0284 to read as follows:
1313 Sec. 26.0284. DISMISSAL OF CERTAIN PROTESTS. (a) In this
1414 section, "protest" means:
1515 (1) a request that the commission hold a contested
1616 case hearing on an application for a wastewater discharge permit;
1717 (2) a request that the commission reconsider the
1818 executive director's decision to issue a wastewater discharge
1919 permit;
2020 (3) a motion requesting that the commission overturn
2121 the executive director's issuance of a wastewater discharge permit;
2222 or
2323 (4) a motion requesting that the commission review its
2424 decision denying a request for a contested case hearing on an
2525 application for a wastewater discharge permit or approving an
2626 application for a wastewater discharge permit after a contested
2727 case hearing has been conducted.
2828 (b) The commission shall dismiss a protest if the protest is
2929 filed by a municipality that is subject to less stringent
3030 wastewater treatment requirements than the requirements
3131 established by the permit.
3232 SECTION 2. The changes in law made by this Act apply only to
3333 a request or motion filed with the Texas Commission on
3434 Environmental Quality on or after the effective date of this Act. A
3535 request or motion filed before the effective date of this Act is
3636 governed by the law in effect on the date the request or motion was
3737 filed, and the former law is continued in effect for that purpose.
3838 SECTION 3. This Act takes effect September 1, 2015.
