20	5		relating to water well drillers and pump installers; authorizing
21	6		fees.
22	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
23	8		SECTION 1. Section 1901.152, Occupations Code, is amended
24	9		to read as follows:
25	10		Sec. 1901.152. LICENSE APPLICATION[; EXAMINATION FEE].
26	11		[(a)] An applicant [application] for a license must submit to the
27	12		department [contain]:
28	13		(1) an application that includes:
29	14		(A) the applicant's name;
30	15		(B) [(2)] the applicant's business address;
31	16		(C) [(3)] the applicant's permanent mailing
32	17		address; and
33	18		(D) [(4)] any other relevant information
34	19		required by the department; and[.]
35	20		(2) [(b) An applicant must pay to the department] an
36	21		application [examination] fee [at the time the application is
37	22		submitted].
38	23		SECTION 2. Subchapter D, Chapter 1901, Occupations Code, is
39	24		amended by adding Section 1901.153 to read as follows:
40	25		Sec. 1901.153. APPRENTICE DRILLER PROGRAM. The commission
41	26		by rule shall establish an apprentice driller program.
42	27		SECTION 3. Section 1901.201, Occupations Code, is amended
43	28		to read as follows:
44	29		Sec. 1901.201. [FREQUENCY OF] EXAMINATION. [(a)] The
45	30		department shall offer examinations for a license under this
46	31		chapter [at least once each year].
47	32		[(b) The department shall offer examinations more
48	33		frequently if more than 10 persons petition for an additional
49	34		examination.]
50	35		SECTION 4. Section 1901.251(b), Occupations Code, is
51	36		amended to read as follows:
52	37		(b) Not later than the 60th day after the date of the
53	38		completion or cessation of drilling, deepening, or otherwise
54	39		altering the well, the driller shall deliver, [or] send by first
55	40		class [certified] mail, or provide electronically a copy of the
56	41		well log to:
57	42		(1) the department;
58	43		(2) the Texas Commission on Environmental Quality
59	44		[Natural Resource Conservation Commission]; and
60	45		(3) the owner of the well or the person for whom the
61	46		well was drilled.
62	47		SECTION 5. Subchapter D, Chapter 1902, Occupations Code, is
63	48		amended by adding Section 1902.153 to read as follows:
64	49		Sec. 1902.153. APPRENTICE PUMP INSTALLER PROGRAM. The
65	50		commission by rule shall establish an apprentice pump installer
66	51		program.
67	52		SECTION 6. Section 1902.201, Occupations Code, is amended
68	53		to read as follows:
69	54		Sec. 1902.201. [FREQUENCY OF] EXAMINATION. [(a)] The
70	55		department shall offer examinations for a license under this
71	56		chapter [at least once each month].
72	57		[(b) The department shall offer examinations more
73	58		frequently if more than 10 persons petition for an additional
74	59		examination.]
75	60		SECTION 7. Not later than December 1, 2015, the Texas
76	61		Commission of Licensing and Regulation shall adopt rules to
77	62		implement the changes in law made by this Act to Chapters 1901 and
78	63		1902, Occupations Code.
79	64		SECTION 8. The Texas Commission of Licensing and Regulation
80	65		may not require a person to hold a license or license specialty
81	66		endorsement as an apprentice driller or apprentice pump installer
82	67		under Sections 1901.153 and 1902.153, Occupations Code, as added by
83	68		this Act, before June 1, 2016.
84	69		SECTION 9. This Act takes effect September 1, 2015.
