205 relating to water well drillers and pump installers; authorizing
216 fees.
227 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
238 SECTION 1. Section 1901.152, Occupations Code, is amended
249 to read as follows:
2510 Sec. 1901.152. LICENSE APPLICATION[; EXAMINATION FEE].
2611 [(a)] An applicant [application] for a license must submit to the
2712 department [contain]:
2813 (1) an application that includes:
2914 (A) the applicant's name;
3015 (B) [(2)] the applicant's business address;
3116 (C) [(3)] the applicant's permanent mailing
3217 address; and
3318 (D) [(4)] any other relevant information
3419 required by the department; and[.]
3520 (2) [(b) An applicant must pay to the department] an
3621 application [examination] fee [at the time the application is
3722 submitted].
3823 SECTION 2. Subchapter D, Chapter 1901, Occupations Code, is
3924 amended by adding Section 1901.153 to read as follows:
4025 Sec. 1901.153. APPRENTICE DRILLER PROGRAM. The commission
4126 by rule shall establish an apprentice driller program.
4227 SECTION 3. Section 1901.201, Occupations Code, is amended
4328 to read as follows:
4429 Sec. 1901.201. [FREQUENCY OF] EXAMINATION. [(a)] The
4530 department shall offer examinations for a license under this
4631 chapter [at least once each year].
4732 [(b) The department shall offer examinations more
4833 frequently if more than 10 persons petition for an additional
4934 examination.]
5035 SECTION 4. Section 1901.251(b), Occupations Code, is
5136 amended to read as follows:
5237 (b) Not later than the 60th day after the date of the
5338 completion or cessation of drilling, deepening, or otherwise
5439 altering the well, the driller shall deliver, [or] send by first
5540 class [certified] mail, or provide electronically a copy of the
5641 well log to:
5742 (1) the department;
5843 (2) the Texas Commission on Environmental Quality
5944 [Natural Resource Conservation Commission]; and
6045 (3) the owner of the well or the person for whom the
6146 well was drilled.
6247 SECTION 5. Subchapter D, Chapter 1902, Occupations Code, is
6348 amended by adding Section 1902.153 to read as follows:
6449 Sec. 1902.153. APPRENTICE PUMP INSTALLER PROGRAM. The
6550 commission by rule shall establish an apprentice pump installer
6651 program.
6752 SECTION 6. Section 1902.201, Occupations Code, is amended
6853 to read as follows:
6954 Sec. 1902.201. [FREQUENCY OF] EXAMINATION. [(a)] The
7055 department shall offer examinations for a license under this
7156 chapter [at least once each month].
7257 [(b) The department shall offer examinations more
7358 frequently if more than 10 persons petition for an additional
7459 examination.]
7560 SECTION 7. Not later than December 1, 2015, the Texas
7661 Commission of Licensing and Regulation shall adopt rules to
7762 implement the changes in law made by this Act to Chapters 1901 and
7863 1902, Occupations Code.
7964 SECTION 8. The Texas Commission of Licensing and Regulation
8065 may not require a person to hold a license or license specialty
8166 endorsement as an apprentice driller or apprentice pump installer
8267 under Sections 1901.153 and 1902.153, Occupations Code, as added by
8368 this Act, before June 1, 2016.
8469 SECTION 9. This Act takes effect September 1, 2015.
