| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 207.021(c), Labor Code, is amended to |
|---|
| 15 | 9 | | read as follows: |
|---|
| 16 | 10 | | (c) Notwithstanding any other provision of this section, an |
|---|
| 17 | 11 | | individual is eligible to receive benefits on the individual's |
|---|
| 18 | 12 | | waiting period claim in accordance with this subtitle if the |
|---|
| 19 | 13 | | individual [who] has been paid benefits in the individual's current |
|---|
| 20 | 14 | | benefit year equal to or exceeding two [three] times the |
|---|
| 21 | 15 | | individual's benefit amount and: |
|---|
| 22 | 16 | | (1) has returned to full-time employment after being |
|---|
| 23 | 17 | | totally or partially unemployed for at least seven consecutive |
|---|
| 24 | 18 | | days; or |
|---|
| 25 | 19 | | (2) has exhausted the individual's regular benefits |
|---|
| 26 | 20 | | for the current benefit year, other than benefits applicable to the |
|---|
| 27 | 21 | | waiting period [is eligible to receive benefits on the individual's |
|---|
| 28 | 22 | | waiting period claim in accordance with this subtitle]. |
|---|
| 29 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 24 | | to a claim for unemployment compensation benefits filed with the |
|---|
| 31 | 25 | | Texas Workforce Commission on or after the effective date of this |
|---|
| 32 | 26 | | Act. A claim filed before the effective date of this Act is |
|---|
| 33 | 27 | | governed by the law in effect on the date the claim was filed, and |
|---|
| 34 | 28 | | the former law is continued in effect for that purpose. |
|---|
| 35 | 29 | | SECTION 3. This Act takes effect September 1, 2015. |
