77 AN ACT
88 relating to the exemption of certain school district property from
99 certain infrastructure fees charged for the control of excess water
1010 or storm water.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 580.003, Local Government Code, as
1313 redesignated by Chapter 885 (H.B. 2278), Acts of the 80th
1414 Legislature, Regular Session, 2007, and amended by Chapters 1356
1515 (H.B. 462) and 1430 (S.B. 3), Acts of the 80th Legislature, Regular
1616 Session, 2007, is reenacted and amended to read as follows:
1717 Sec. 580.003. EXEMPTIONS OF CERTAIN PROPERTY FROM
1818 INFRASTRUCTURE FEES. (a) Except as provided by Subsection (b), no
1919 county, municipality, or utility district may collect from a state
2020 agency, [or] a public or private institution of higher education,
2121 or a school district described by Subsection (c) any fee charged for
2222 the development or maintenance of programs or facilities for the
2323 control of excess water or storm water.
2424 (b) A municipality with a population of 25,000 or less and
2525 through which the Bosque River runs may collect from a state agency
2626 or public institution of higher education a fee charged for the
2727 development or maintenance of programs or [of] facilities for the
2828 control of excess water or storm water.
2929 (c) This section applies only to a school district located
3030 in a county with a population of more than 1.5 million that contains
3131 a municipality in which at least 75 percent of the county's
3232 population resides.
3333 SECTION 2. The change in law made by this Act does not
3434 affect fees imposed before the effective date of this Act, and the
3535 law in effect before that date is continued in effect for the
3636 purpose of the liability for and collection of those fees.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2015.
