| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 580.003, Local Government Code, as |
|---|
| 13 | 13 | | redesignated by Chapter 885 (H.B. 2278), Acts of the 80th |
|---|
| 14 | 14 | | Legislature, Regular Session, 2007, and amended by Chapters 1356 |
|---|
| 15 | 15 | | (H.B. 462) and 1430 (S.B. 3), Acts of the 80th Legislature, Regular |
|---|
| 16 | 16 | | Session, 2007, is reenacted and amended to read as follows: |

| 17 | 17 | | Sec. 580.003. EXEMPTIONS OF CERTAIN PROPERTY FROM |
|---|
| 18 | 18 | | INFRASTRUCTURE FEES. (a) Except as provided by Subsection (b), no |
|---|
| 19 | 19 | | county, municipality, or utility district may collect from a state |
|---|
| 20 | 20 | | agency, [or] a public or private institution of higher education, |
|---|
| 21 | 21 | | or a school district described by Subsection (c) any fee charged for |
|---|
| 22 | 22 | | the development or maintenance of programs or facilities for the |
|---|
| 23 | 23 | | control of excess water or storm water. |
|---|
| 24 | 24 | | (b) A municipality with a population of 25,000 or less and |
|---|
| 25 | 25 | | through which the Bosque River runs may collect from a state agency |
|---|
| 26 | 26 | | or public institution of higher education a fee charged for the |
|---|
| 27 | 27 | | development or maintenance of programs or [of] facilities for the |
|---|
| 28 | 28 | | control of excess water or storm water. |
|---|
| 29 | 29 | | (c) This section applies only to a school district located |
|---|
| 30 | 30 | | in a county with a population of more than 1.5 million that contains |
|---|
| 31 | 31 | | a municipality in which at least 75 percent of the county's |
|---|
| 32 | 32 | | population resides. |
|---|
| 33 | 33 | | SECTION 2. The change in law made by this Act does not |
|---|
| 34 | 34 | | affect fees imposed before the effective date of this Act, and the |
|---|
| 35 | 35 | | law in effect before that date is continued in effect for the |
|---|
| 36 | 36 | | purpose of the liability for and collection of those fees. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2015. |
