9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 52f, Article III, Texas Constitution, is |

11 | 11 | | amended to read as follows: |
---|
12 | 12 | | Sec. 52f. A county with a population of 7,500 [5,000] or |
---|
13 | 13 | | less, according to the most recent federal census, may construct |
---|
14 | 14 | | and maintain private roads if it imposes a reasonable charge for the |
---|
15 | 15 | | work. The Legislature by general law may limit this authority. |
---|
16 | 16 | | Revenue received from private road work may be used only for the |
---|
17 | 17 | | construction, including right-of-way acquisition, or maintenance |
---|
18 | 18 | | of public roads. |
---|
19 | 19 | | SECTION 2. This proposed constitutional amendment shall be |
---|
20 | 20 | | submitted to the voters at an election to be held November 3, 2015. |
---|
21 | 21 | | The ballot shall be printed to permit voting for or against the |
---|
22 | 22 | | proposition: "The constitutional amendment to authorize counties |
---|
23 | 23 | | with a population of 7,500 or less to perform private road |
---|
24 | 24 | | construction and maintenance." |
