77 proposing a constitutional amendment relating to private road work

99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 52f, Article III, Texas Constitution, is
1111 amended to read as follows:
1212 Sec. 52f. A county with a population of 7,500 [5,000] or
1313 less, according to the most recent federal census, may construct
1414 and maintain private roads if it imposes a reasonable charge for the
1515 work. The Legislature by general law may limit this authority.
1616 Revenue received from private road work may be used only for the
1717 construction, including right-of-way acquisition, or maintenance
1818 of public roads.
1919 SECTION 2. This proposed constitutional amendment shall be
2020 submitted to the voters at an election to be held November 3, 2015.
2121 The ballot shall be printed to permit voting for or against the
2222 proposition: "The constitutional amendment to authorize counties
2323 with a population of 7,500 or less to perform private road
2424 construction and maintenance."
