66 A JOINT RESOLUTION
77 applying to the Congress of the United States to call a convention
88 under Article V of the United States Constitution for the limited
99 purpose of proposing one or more amendments to the constitution to
1010 impose fiscal restraints on the federal government, to limit the
1111 power and jurisdiction of the federal government, and to limit the
1212 terms of office of federal officials and members of Congress.
1313 WHEREAS, The drafters of the United States Constitution
1414 empowered state legislatures to be guardians of liberty against
1515 abuses of power by the federal government; and
1616 WHEREAS, The federal government has abused its power by
1717 creating a crushing national debt through improper and imprudent
1818 spending; and
1919 WHEREAS, The federal government has abused its power by
2020 invading the legitimate role of the states through the manipulative
2121 process of federal mandates that are to a great extent unfunded; and
2222 WHEREAS, The federal government has ceased to abide by a
2323 proper interpretation of the United States Constitution; and
2424 WHEREAS, It is the solemn duty of state legislatures to
2525 protect the liberty of the people and of future generations by
2626 proposing amendments to the United States Constitution that place
2727 clear restraints on federal power; and
2828 WHEREAS, Article V of the United States Constitution
2929 authorizes the several state legislatures to restrict the power of
3030 the federal government through the amendment process; and
3131 WHEREAS, Article V of the United States Constitution provides
3232 that on application of the legislatures of two-thirds of the
3333 several states Congress shall call a convention for the purpose of
3434 proposing amendments to the constitution; now, therefore, be it
3535 RESOLVED, That the 84th Texas Legislature apply to Congress
3636 to call a convention under Article V of the United States
3737 Constitution for the limited purpose of proposing one or more
3838 amendments to the constitution to impose fiscal restraints on the
3939 federal government, to limit the power and jurisdiction of the
4040 federal government, and to limit the terms of office of federal
4141 officials and members of Congress; and, be it further
4242 RESOLVED, That, unless rescinded by a succeeding
4343 legislature, this application by the 84th Texas Legislature
4444 constitutes a continuing application in accordance with Article V
4545 of the United States Constitution until at least two-thirds of the
4646 legislatures of the several states have applied to Congress to call
4747 a convention for the limited purpose of proposing one or more
4848 amendments to the constitution to impose fiscal restraints on the
4949 federal government, to limit the power and jurisdiction of the
5050 federal government, and to limit the terms of office of federal
5151 officials and members of Congress; and, be it further
5252 RESOLVED, That the Texas secretary of state forward official
5353 copies of this resolution to the president of the United States, to
5454 the speaker of the House of Representatives and the president of the
5555 Senate of the Congress of the United States, and to all members of
5656 the Texas delegation to Congress with the request that this
5757 resolution be officially entered in the Congressional Record as an
5858 application to Congress for a convention under Article V of the
5959 United States Constitution for the limited purpose of proposing one
6060 or more amendments to the constitution to impose fiscal restraints
6161 on the federal government, to limit the power and jurisdiction of
6262 the federal government, and to limit the terms of office of federal
6363 officials and members of Congress; and, be it further
6464 RESOLVED, That the Texas secretary of state forward official
6565 copies of this resolution to the secretaries of state and to the
6666 presiding officers of the legislatures of the several states with
6767 the request that they join this state in applying to Congress for a
6868 convention under Article V of the United States Constitution for
6969 the limited purpose of proposing one or more amendments to the
7070 constitution to impose fiscal restraints on the federal government,
7171 to limit the power and jurisdiction of the federal government, and
7272 to limit the terms of office of federal officials and members of
7373 Congress.
