55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to required disclosures in and to the length of ballot
88 proposition language authorizing political subdivisions to issue
99 bonds or impose or change a tax.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 52.072, Election Code, is amended by
1212 adding Subsections (f) and (f-1) to read as follows:
1313 (f) In addition to the requirements of Subsection (e) and
1414 any other requirement imposed by law for a proposition, including a
1515 provision prescribing the proposition language, a proposition
1616 submitted to the voters for approval of the issuance of bonds or the
1717 imposition, increase, or reduction of a tax shall for any political
1818 subdivision, including municipalities, counties, school districts,
1919 and special taxing districts, specifically state, as applicable:
2020 (1) with respect to a proposition seeking voter
2121 approval of the issuance of bonds:
2222 (A) the total amount of the political
2323 subdivision's debt secured by ad valorem taxes currently
2424 outstanding;
2525 (B) the total amount of the political
2626 subdivision's current payments on debt secured by ad valorem taxes;
2727 (C) the amount of taxes required to be imposed on
2828 a homestead with a value equal to the median homestead value in the
2929 political subdivision, as computed by the appraisal district, to
3030 repay the political subdivision's current debt obligations secured
3131 by ad valorem taxes; and
3232 (D) the estimated tax burden that would be
3333 imposed on a homestead with a value equal to the median homestead
3434 value in the political subdivision, as computed by the appraisal
3535 district, to repay the bonds to be authorized, if approved;
3636 (2) with respect to a proposition that only seeks
3737 voter approval of the imposition or increase of a tax:
3838 (A) the estimated additional tax burden that
3939 would be imposed on a homestead with a value equal to the median
4040 homestead value in the political subdivision, as computed by the
4141 appraisal district, after the imposition or increase of the tax, if
4242 approved; and
4343 (B) a detailed description of the purposes for
4444 which the tax is to be imposed or increased, if approved; or
4545 (3) with respect to a proposition that only seeks
4646 voter approval of the reduction of a tax, the estimated tax
4747 reduction for a homestead with a value equal to the median homestead
4848 value in the political subdivision, as computed by the appraisal
4949 district, if the reduction of the tax is approved.
5050 (f-1) A proposition to which Subsection (e) applies may not
5151 exceed:
5252 (1) 5,000 characters; or
5353 (2) a different limit prescribed by the secretary of
5454 state that ensures that the length of the proposition does not
5555 exceed one page of the ballot or one screen on an electronic voting
5656 machine.
5757 SECTION 2. The changes in law made by this Act apply only to
5858 a ballot for an election ordered on or after the effective date of
5959 this Act. An election ordered before the effective date of this Act
6060 is governed by the law in effect when the election was ordered, and
6161 the former law is continued in effect for that purpose.
6262 SECTION 3. This Act takes effect September 1, 2015.
