5- A BILL TO BE ENTITLED
64 AN ACT
75 relating to the transportation of a person with a mental illness.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 574.045, Health and Safety Code, is
108 amended by adding Subsection (l) to read as follows:
119 (l) A patient restrained under Subsection (g) may be
1210 restrained only during the apprehension, detention, or
1311 transportation of the patient. The method of restraint must permit
1412 the patient to sit in an upright position without undue difficulty
1513 unless the patient is being transported by ambulance.
1614 SECTION 2. This Act takes effect immediately if it receives
1715 a vote of two-thirds of all the members elected to each house, as
1816 provided by Section 39, Article III, Texas Constitution. If this
1917 Act does not receive the vote necessary for immediate effect, this
2018 Act takes effect September 1, 2015.
