| 8 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 7 | | SECTION 1. Section 574.045, Health and Safety Code, is |
|---|
| 10 | 8 | | amended by adding Subsection (l) to read as follows: |
|---|
| 11 | 9 | | (l) A patient restrained under Subsection (g) may be |
|---|
| 12 | 10 | | restrained only during the apprehension, detention, or |
|---|
| 13 | 11 | | transportation of the patient. The method of restraint must permit |
|---|
| 14 | 12 | | the patient to sit in an upright position without undue difficulty |
|---|
| 15 | 13 | | unless the patient is being transported by ambulance. |
|---|
| 16 | 14 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 17 | 15 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 18 | 16 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 19 | 17 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 20 | 18 | | Act takes effect September 1, 2015. |
