| 12 | 8 | | researchers to make research papers available to the public. |

| 13 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 10 | | SECTION 1. Subchapter C, Chapter 61, Education Code, is |
|---|
| 15 | 11 | | amended by adding Section 61.0663 to read as follows: |
|---|
| 16 | 12 | | Sec. 61.0663. FEASIBILITY STUDY ON COLLECTING PUBLISHED |
|---|
| 17 | 13 | | RESEARCH. (a) This section applies only to a researcher whose |
|---|
| 18 | 14 | | research is funded wholly or partly with: |
|---|
| 19 | 15 | | (1) state money; or |
|---|
| 20 | 16 | | (2) federal money, if the research is conducted in |
|---|
| 21 | 17 | | this state or by an institution of higher education. |
|---|
| 22 | 18 | | (b) The board, in consultation with institutions of higher |
|---|
| 23 | 19 | | education, publishing companies, and any other interested persons |
|---|
| 24 | 20 | | the board considers appropriate, shall study the feasibility of |
|---|
| 25 | 21 | | requiring each researcher to submit to a state agency an electronic |
|---|
| 26 | 22 | | copy of each original research paper by the researcher that is |
|---|
| 27 | 23 | | accepted for publication in a peer-reviewed journal. The study |
|---|
| 28 | 24 | | must examine: |
|---|
| 29 | 25 | | (1) the time requirements for submitting a research |
|---|
| 30 | 26 | | paper; |
|---|
| 31 | 27 | | (2) the manner for making the research paper available |
|---|
| 32 | 28 | | to the public, including posting on an Internet website; |
|---|
| 33 | 29 | | (3) the state agencies that have the resources |
|---|
| 34 | 30 | | necessary to collect research papers and coordinate the |
|---|
| 35 | 31 | | dissemination of the research papers; and |
|---|
| 36 | 32 | | (4) federal law requirements on the publication of a |
|---|
| 37 | 33 | | research paper by a researcher whose research is funded with |
|---|
| 38 | 34 | | federal money. |
|---|
| 39 | 35 | | (c) Not later than December 1, 2016, the board shall report |
|---|
| 40 | 36 | | the results of the study, its findings, and any recommendations to |
|---|
| 41 | 37 | | the legislature. |
|---|
| 42 | 38 | | (d) This section expires September 1, 2017. |
|---|
| 43 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 44 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 43 | | Act takes effect September 1, 2015. |
