95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to a study on the feasibility of requiring certain
128 researchers to make research papers available to the public.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1511 amended by adding Section 61.0663 to read as follows:
1612 Sec. 61.0663. FEASIBILITY STUDY ON COLLECTING PUBLISHED
1713 RESEARCH. (a) This section applies only to a researcher whose
1814 research is funded wholly or partly with:
1915 (1) state money; or
2016 (2) federal money, if the research is conducted in
2117 this state or by an institution of higher education.
2218 (b) The board, in consultation with institutions of higher
2319 education, publishing companies, and any other interested persons
2420 the board considers appropriate, shall study the feasibility of
2521 requiring each researcher to submit to a state agency an electronic
2622 copy of each original research paper by the researcher that is
2723 accepted for publication in a peer-reviewed journal. The study
2824 must examine:
2925 (1) the time requirements for submitting a research
3026 paper;
3127 (2) the manner for making the research paper available
3228 to the public, including posting on an Internet website;
3329 (3) the state agencies that have the resources
3430 necessary to collect research papers and coordinate the
3531 dissemination of the research papers; and
3632 (4) federal law requirements on the publication of a
3733 research paper by a researcher whose research is funded with
3834 federal money.
3935 (c) Not later than December 1, 2016, the board shall report
4036 the results of the study, its findings, and any recommendations to
4137 the legislature.
4238 (d) This section expires September 1, 2017.
4339 SECTION 2. This Act takes effect immediately if it receives
4440 a vote of two-thirds of all the members elected to each house, as
4541 provided by Section 39, Article III, Texas Constitution. If this
4642 Act does not receive the vote necessary for immediate effect, this
4743 Act takes effect September 1, 2015.
