| 15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Section 54.5041(h), Education Code, is amended |
|---|
| 17 | 17 | | to read as follows: |
|---|
| 18 | 18 | | (h) The fee may not be charged after the fifth academic year |
|---|
| 19 | 19 | | in which the fee is first charged unless: |
|---|
| 20 | 20 | | (1) [, before the end of that academic year,] the |
|---|
| 21 | 21 | | institution has issued bonds payable in whole or in part from the |
|---|
| 22 | 22 | | fee, in which event the fee may not be charged after the academic |
|---|
| 23 | 23 | | year in which all such bonds, including refunding bonds for those |
|---|
| 24 | 24 | | bonds, have been fully paid; or |
|---|
| 25 | 25 | | (2) the continuation of the fee is approved every five |
|---|
| 26 | 26 | | years by a majority vote of the students enrolled at the institution |
|---|
| 27 | 27 | | who participate in a general student election called for that |
|---|
| 28 | 28 | | purpose. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2015. |
