1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to an environmental service fee charged by an institution
1414 of higher education.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 54.5041(h), Education Code, is amended
1717 to read as follows:
1818 (h) The fee may not be charged after the fifth academic year
1919 in which the fee is first charged unless:
2020 (1) [, before the end of that academic year,] the
2121 institution has issued bonds payable in whole or in part from the
2222 fee, in which event the fee may not be charged after the academic
2323 year in which all such bonds, including refunding bonds for those
2424 bonds, have been fully paid; or
2525 (2) the continuation of the fee is approved every five
2626 years by a majority vote of the students enrolled at the institution
2727 who participate in a general student election called for that
2828 purpose.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2015.
