134 A BILL TO BE ENTITLED
145 AN ACT
156 relating to an interstate compact on border security and
167 immigration enforcement.
178 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
189 SECTION 1. Title 7, Government Code, is amended by adding
1910 Chapter 793 to read as follows:
2011 CHAPTER 793. INTERSTATE COMPACT FOR BORDER SECURITY
2112 Sec. 793.001. DEFINITION. In this chapter, "illegal alien"
2213 means a person who:
2314 (1) is not a citizen or national of the United States;
2415 and
2516 (2) is unlawfully present in the United States
2617 according to the terms of 8 U.S.C. Section 1101 et seq.
2718 Sec. 793.002. AUTHORITY TO EXECUTE INTERSTATE COMPACT. On
2819 behalf of this state, the governor shall:
2920 (1) coordinate, develop, and execute an interstate
30- compact for border security among interested states;
31- (2) call a special session of the legislature to adopt
32- a compact described by Subdivision (1) on or before the 31st day
33- after another state adopts the compact; and
34- (3) seek the approval of the United States Congress
21+ compact for border security among interested states; and
22+ (2) seek the approval of the United States Congress
3523 for the compact.
3624 Sec. 793.003. INTERSTATE COMPACT PROVISIONS. The compact
3725 required by this chapter must provide for joint action among
3826 compacting states on matters that include:
3927 (1) the operational control of this state's border
4028 with Mexico by the total detection and apprehension or deflection
4129 of illegal aliens attempting to cross the border into this state;
4230 and
4331 (2) otherwise enforcing federal immigration laws,
4432 including detecting, apprehending, detaining, prosecuting,
4533 releasing, and monitoring of illegal aliens.
4634 SECTION 2. This Act takes effect immediately if it receives
4735 a vote of two-thirds of all the members elected to each house, as
4836 provided by Section 39, Article III, Texas Constitution. If this
4937 Act does not receive the vote necessary for immediate effect, this
5038 Act takes effect September 1, 2015.
