| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 33.023, Utilities Code, is amended by | |
| 12 | 12 | adding Subsection (c) to read as follows: | |
| 13 | 13 | (c) An electric utility that recovers its reasonable costs | |
| 14 | 14 | of reimbursing the governing body's expenses under this section may | |
| 15 | 15 | recover the costs only on a uniform, system-wide basis. | |
| 16 | 16 | SECTION 2. Section 36.061, Utilities Code, is amended by | |
| 17 | 17 | adding Subsection (b-1) to read as follows: | |
| 18 | 18 | (b-1) Any amount approved as a cost or expense may be | |
| 19 | 19 | recovered by the electric utility only on a uniform, system-wide | |
| 20 | 20 | basis. | |
| 21 | 21 | SECTION 3. The change in law made by this Act applies only | |
| 22 | 22 | to a rate proceeding in which the initial hearing is held on or | |
| 23 | 23 | after the effective date of this Act. A proceeding in which the | |
| 24 | 24 | initial hearing is held before that date is governed by the law in | |
| 25 | 25 | effect immediately before the effective date of this Act, and that | |
| 26 | 26 | law is continued in effect for that purpose. | |
| 27 | 27 | SECTION 4. This Act takes effect September 1, 2015. |
