A BILL TO BE ENTITLED
AN ACT
relating to the recovery of certain expenses by an electric utility
in a ratemaking proceeding; adding provisions subject to a criminal
penalty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 33.023, Utilities Code, is amended by
adding Subsection (c) to read as follows:
(c) An electric utility that recovers its reasonable costs
of reimbursing the governing body's expenses under this section may
recover the costs only on a uniform, system-wide basis.
SECTION 2. Section 36.061, Utilities Code, is amended by
adding Subsection (b-1) to read as follows:
(b-1) Any amount approved as a cost or expense may be
recovered by the electric utility only on a uniform, system-wide
basis.
SECTION 3. The change in law made by this Act applies only
to a rate proceeding in which the initial hearing is held on or
after the effective date of this Act. A proceeding in which the
initial hearing is held before that date is governed by the law in
effect immediately before the effective date of this Act, and that
law is continued in effect for that purpose.
SECTION 4. This Act takes effect September 1, 2015.
