66 AN ACT
77 relating to separate negotiations regarding employment matters for
88 police officers and firefighters in certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 147, Local Government
1111 Code, is amended to read as follows:
1212 CHAPTER 147. LOCAL CONTROL OF FIREFIGHTER [AND POLICE OFFICER]
1313 EMPLOYMENT MATTERS IN CERTAIN MUNICIPALITIES WITH POPULATION OF ONE
1414 MILLION OR MORE
1515 SECTION 2. Sections 147.003(a), (b), (c), and (d), Local
1616 Government Code, are amended to read as follows:
1717 (a) A meet and confer team is created under this section and
1818 consists of [the following members:
1919 [(1)] members representing the firefighter employee
2020 groups in the municipality, provided each group may appoint only
2121 one firefighter of the municipality to serve as a member of the team
2222 [; and
2323 [(2) members representing the police officer employee
2424 groups in the municipality, provided each group may appoint only
2525 one police officer of the municipality to serve as a member of the
2626 team].
2727 (b) The meet and confer team represents all firefighters
2828 [and police officers] in the municipality and shall negotiate with
2929 the municipality in an effort to reach an agreement on concerns
3030 shared by the firefighters [and police officers] regarding terms of
3131 employment, including concerns relating to wages, benefits, and
3232 other working conditions but excluding concerns relating to
3333 pensions. Only the meet and confer team created under this section
3434 may represent the firefighters [or police officers] of the
3535 municipality in the capacity described by this subsection, except
3636 that the team may be accompanied by legal counsel.
3737 (c) Concerns relating to affirmative action, employment
3838 discrimination, hiring, and promotions may be discussed by
3939 individual firefighter [and police officer] associations
4040 independent of the meet and confer team.
4141 (d) Expenses associated with the meet and confer team must
4242 be divided pro rata among each firefighter employee group [and
4343 police officer employee group] based on the number of sworn fire [or
4444 police] department members represented by each group.
4545 SECTION 3. Section 147.0031, Local Government Code, is
4646 amended to read as follows:
4747 Sec. 147.0031. PETITION FOR RECOGNITION: ELECTION OR ACTION
4848 BY GOVERNING BODY. (a) Not later than the 30th day after the date
4949 the governing body of a municipality receives from the meet and
5050 confer team a petition signed by a majority of all [police officers
5151 and a majority of all] firefighters, excluding the head of the
5252 [police department, the head of the] fire department [,] and other
5353 excluded employees as described by Section 147.0035(b), that
5454 requests recognition of the meet and confer team as the sole and
5555 exclusive bargaining agent for all the [police officers and]
5656 firefighters employed by the municipality, excluding the head of
5757 the [police department, the head of the] fire department [,] and
5858 other excluded employees as described by Section 147.0035(b), the
5959 governing body shall:
6060 (1) grant recognition of the meet and confer team as
6161 requested in the petition and determine by majority vote that the
6262 municipality may meet and confer under this chapter without
6363 conducting an election by the voters in the municipality under
6464 Section 147.0033;
6565 (2) defer granting recognition of the meet and confer
6666 team and order an election by the voters in the municipality under
6767 Section 147.0033 regarding whether the municipality may meet and
6868 confer under this chapter; or
6969 (3) order a certification election under Section
7070 147.0032 to determine whether the employee groups in the meet and
7171 confer team represent a majority of the covered [police officers
7272 and a majority of the covered] firefighters.
7373 (b) If the governing body of a municipality orders a
7474 certification election under Subsection (a)(3) and the employee
7575 groups that are part of the meet and confer team are certified to
7676 represent a majority of the covered [police officers and a majority
7777 of the covered] firefighters, the governing body shall, not later
7878 than the 30th day after the date that results of that election are
7979 certified:
8080 (1) grant recognition of the meet and confer team as
8181 requested in the petition for recognition and determine by majority
8282 vote that the municipality may meet and confer under this chapter
8383 without conducting an election by the voters in the municipality
8484 under Section 147.0033; or
8585 (2) defer granting recognition of the meet and confer
8686 team and order an election by the voters in the municipality under
8787 Section 147.0033 regarding whether a public employer may meet and
8888 confer under this chapter.
8989 SECTION 4. Section 147.0032(a), Local Government Code, is
9090 amended to read as follows:
9191 (a) Except as provided by Subsection (b), a certification
9292 election ordered under Section 147.0031(a)(3) to determine whether
9393 the employee groups in the meet and confer team represent a majority
9494 of the covered [police officers and a majority of the covered]
9595 firefighters shall be conducted according to procedures agreeable
9696 to the parties.
9797 SECTION 5. Section 147.0033(c), Local Government Code, is
9898 amended to read as follows:
9999 (c) The ballot for an election ordered under this section
100100 shall be printed to permit voting for or against the
101101 proposition: "Authorizing __________ (name of the municipality)
102102 to operate under the state law allowing a municipality to meet and
103103 confer and make agreements with the meet and confer team
104104 representing municipal [police officers and] firefighters as
105105 provided by state law, preserving the prohibition against strikes
106106 and organized work stoppages, and providing penalties for strikes
107107 and organized work stoppages."
108108 SECTION 6. Section 147.0034(a), Local Government Code, is
109109 amended to read as follows:
110110 (a) The [police officers and] firefighters may withdraw the
111111 recognition of the meet and confer team granted under this chapter
112112 by filing with the governing body of the municipality a petition
113113 signed by a majority of all covered [police officers and a majority
114114 of all covered] firefighters.
115115 SECTION 7. Section 147.0035, Local Government Code, is
116116 amended to read as follows:
117117 Sec. 147.0035. RECOGNITION OF MEET AND CONFER TEAM. (a) A
118118 public employer in a municipality that chooses to meet and confer
119119 under this chapter shall recognize the meet and confer team that is
120120 recognized under Section 147.0031 or 147.0033 as the sole and
121121 exclusive bargaining agent for the [police officers and]
122122 firefighters, excluding the head of the [police department, head of
123123 the] fire department [,] and the employees exempt under Subsection
124124 (b), in accordance with this chapter and the petition.
125125 (b) For the purposes of Subsection (a), exempt employees are
126126 employees appointed by the head of the [police department or] fire
127127 department in the classification immediately below that of
128128 department head or that are exempt by the mutual agreement of the
129129 meet and confer team and the municipality.
130130 (c) The municipality shall recognize the meet and confer
131131 team until recognition of the meet and confer team is withdrawn in
132132 accordance with Section 147.0034 by a majority of the [police
133133 officers and a majority of the] firefighters who are eligible to
134134 sign a petition for recognition.
135135 SECTION 8. Sections 147.004(a), (c), and (d), Local
136136 Government Code, are amended to read as follows:
137137 (a) A municipality may not be denied local control over the
138138 wages, salaries, rates of pay, hours of work, and other terms of
139139 employment, or other state-mandated personnel issues, if the
140140 municipality and the meet and confer team recognized under Section
141141 147.0031 or 147.0033 as the sole and exclusive bargaining agent for
142142 the covered [police officers and] firefighters come to a mutual
143143 agreement on any of the terms of employment. If an agreement is not
144144 reached, the state laws, local ordinances, and civil service rules
145145 remain unaffected. All agreements shall be written. Nothing in
146146 this chapter requires either party to meet and confer on any issue
147147 or reach an agreement.
148148 (c) Firefighters [and police officers] of a municipality
149149 may not engage in strikes against this state or a political
150150 subdivision of this state. A firefighter [or police officer] who
151151 participates in a strike forfeits all civil service rights,
152152 reemployment rights, and any other rights, benefits, or privileges
153153 the firefighter [or police officer] enjoys as a result of
154154 employment or prior employment.
155155 (d) In this section, "strike" means failing to report for
156156 duty in concerted action with others, wilfully being absent from an
157157 assigned position, stopping work, abstaining from the full,
158158 faithful, and proper performance of the duties of employment, or
159159 interfering with the operation of a municipality. However, this
160160 section does not prohibit a firefighter [or police officer] from
161161 conferring with members of the municipal governing body about
162162 conditions, compensation, rights, privileges, or obligations of
163163 employment.
164164 SECTION 9. Section 147.005, Local Government Code, is
165165 amended to read as follows:
166166 Sec. 147.005. PAYROLL DUES DEDUCTIONS. The municipality
167167 may not prevent automatic payroll deductions for dues paid to a
168168 firefighter employee group [or police officer employee group].
169169 SECTION 10. Section 147.007(a), Local Government Code, is
170170 amended to read as follows:
171171 (a) A written agreement made under this chapter between a
172172 municipality and the meet and confer team is enforceable and
173173 binding on the municipality, the meet and confer team, firefighter
174174 employee groups, [police officer employee groups,] and the
175175 firefighters [and police officers] covered by the agreement if:
176176 (1) the municipality's governing body ratified the
177177 agreement by a majority vote; and
178178 (2) the agreement is ratified under Section 147.008.
179179 SECTION 11. Sections 147.008(b) and (d), Local Government
180180 Code, are amended to read as follows:
181181 (b) All firefighters [and police officers] of the
182182 municipality are eligible to vote in the election.
183183 (d) A firefighter [or police officer] who is not a member of
184184 a firefighter employee group [or a police officer employee group]
185185 may be assessed a fee for any cost associated with casting the
186186 firefighter's [or police officer's] vote.
187187 SECTION 12. Section 147.009(d), Local Government Code, is
188188 amended to read as follows:
189189 (d) The ballot for an election ordered under Subsection (b)
190190 shall be printed to allow voting for or against the
191191 proposition: "Authorizing __________ (name of the municipality)
192192 to continue to operate under the state law allowing a municipality
193193 to meet and confer and make agreements with the meet and confer team
194194 representing municipal [police officers and] firefighters as
195195 provided by state law, preserving the prohibition against strikes
196196 and organized work stoppages, and providing penalties for strikes
197197 and organized work stoppages."
198198 SECTION 13. Chapter 147, Local Government Code, is amended
199199 by adding Section 147.0091 to read as follows:
200200 Sec. 147.0091. TEMPORARY PROVISION: ACTION TO WITHDRAW
201201 RECOGNITION OF POLICE OFFICER AND FIREFIGHTER MEET AND CONFER TEAM
202202 UNDER THIS CHAPTER. (a) Notwithstanding Sections 147.009(b)
203203 through (g), the governing body of a municipality that granted
204204 recognition of a meet and confer team as the sole and exclusive
205205 bargaining agent of all police officers and firefighters under
206206 Section 147.0031 before September 1, 2015, shall, not later than
207207 September 30, 2015, withdraw recognition of the meet and confer
208208 team by providing to the meet and confer team written notice that:
209209 (1) pursuant to __.B. No. __, Acts of the 84th
210210 Legislature, Regular Session, 2015, the governing body is
211211 withdrawing recognition of the meet and confer team; and
212212 (2) any agreement between the governing body and the
213213 meet and confer team will not be renewed.
214214 (b) This section expires September 1, 2025.
215215 SECTION 14. Sections 147.010(a) and (c), Local Government
216216 Code, are amended to read as follows:
217217 (a) Not later than the 60th day after the date a meet and
218218 confer agreement is ratified by the governing body of the
219219 municipality and the firefighters [and police officers] under
220220 Section 147.008, a petition calling for the repeal of the agreement
221221 signed by a number of registered voters residing in the
222222 municipality equal to at least 10 percent of the votes cast at the
223223 most recent general election held in the municipality may be
224224 presented to the person charged with ordering an election under
225225 Section 3.004, Election Code.
226226 (c) An election called under Subsection (b)(2) may be held
227227 as part of the next regularly scheduled general election for the
228228 municipality. The ballot shall be printed to provide for voting
229229 for or against the proposition: "Repeal the meet and confer
230230 agreement ratified on __________ (date agreement was ratified) by
231231 the __________ (name of the governing body of the municipality) and
232232 the [police officers and] firefighters employed by the City of
233233 __________ (name of municipality) concerning wages, salaries,
234234 rates of pay, hours of work, and other terms of employment."
235235 SECTION 15. Section 147.011, Local Government Code, is
236236 amended to read as follows:
237237 Sec. 147.011. EFFECT ON EXISTING BENEFITS AND RIGHTS. (a)
238238 This chapter may not be construed to repeal any existing benefit
239239 provided by statute or ordinance concerning [police officers' or]
240240 firefighters' compensation, pensions, retirement plans, hours of
241241 work, conditions of employment, or other emoluments except as
242242 expressly provided in a ratified meet and confer agreement. This
243243 chapter is in addition to the benefits provided by existing
244244 statutes and ordinances.
245245 (b) This chapter may not be construed to interfere with the
246246 free speech right, guaranteed by the First Amendment to the United
247247 States Constitution, of an individual firefighter [or a police
248248 officer] to endorse or dissent from any agreement.
249249 SECTION 16. Subtitle A, Title 5, Local Government Code, is
250250 amended by adding Chapter 148 to read as follows:
251251 CHAPTER 148. LOCAL CONTROL OF POLICE OFFICER EMPLOYMENT MATTERS IN
252252 CERTAIN MUNICIPALITIES WITH POPULATION OF ONE MILLION OR MORE
253253 Sec. 148.001. APPLICABILITY. This chapter applies only to
254254 a municipality with a population of one million or more, but does
255255 not apply to a municipality that has adopted Chapter 143 or 174.
256256 Sec. 148.002. DEFINITIONS. In this chapter:
257257 (1) "Police officer" means a sworn police officer
258258 employed by the municipality who is covered by the municipality's
259259 police pension plan and is classified by the municipality as
260260 nonexempt. The term does not include a police officer with a rank
261261 above that of captain, a civilian, or a municipal marshal.
262262 (2) "Police officer employee group" means an
263263 organization:
264264 (A) in which, on or before September 1, 2007, at
265265 least three percent of the police officers of the municipality have
266266 participated and paid dues via automatic payroll deduction; and
267267 (B) that exists for the purpose, in whole or in
268268 part, of dealing with the municipality concerning grievances, labor
269269 disputes, wages, rates of pay, hours of employment, or conditions
270270 of employment affecting police officers.
271271 Sec. 148.003. MEET AND CONFER TEAM; NEGOTIATIONS. (a) A
272272 meet and confer team is created under this section and consists of
273273 members representing the police officer employee groups in the
274274 municipality, provided each group may appoint only one police
275275 officer of the municipality to serve as a member of the team.
276276 (b) The meet and confer team represents all police officers
277277 in the municipality and shall negotiate with the municipality in an
278278 effort to reach an agreement on concerns shared by the police
279279 officers regarding terms of employment, including concerns
280280 relating to wages, benefits, and other working conditions but
281281 excluding concerns relating to pensions. Only the meet and confer
282282 team created under this section may represent the police officers
283283 of the municipality in the capacity described by this subsection,
284284 except that the team may be accompanied by a representative of the
285285 team's choosing to assist with the negotiation process.
286286 (c) Concerns relating to affirmative action, employment
287287 discrimination, hiring, and promotions may be discussed by
288288 individual police officer associations independent of the meet and
289289 confer team.
290290 (d) Expenses associated with the meet and confer team must
291291 be divided pro rata among each police officer employee group based
292292 on the number of sworn police department members represented by
293293 each group.
294294 (e) A municipality may designate one or more persons to meet
295295 and confer on the municipality's behalf.
296296 Sec. 148.0031. PETITION FOR RECOGNITION: ELECTION OR ACTION
297297 BY GOVERNING BODY. (a) Not later than the 30th day after the date
298298 the governing body of a municipality receives from the meet and
299299 confer team a petition signed by a majority of all police officers,
300300 excluding the head of the police department and other excluded
301301 employees as described by Section 148.0035(b), that requests
302302 recognition of the meet and confer team as the sole and exclusive
303303 bargaining agent for all the police officers employed by the
304304 municipality, excluding the head of the police department and other
305305 excluded employees as described by Section 148.0035(b), the
306306 governing body shall:
307307 (1) grant recognition of the meet and confer team as
308308 requested in the petition and determine by majority vote that the
309309 municipality may meet and confer under this chapter without
310310 conducting an election by the voters in the municipality under
311311 Section 148.0033;
312312 (2) defer granting recognition of the meet and confer
313313 team and order an election by the voters in the municipality under
314314 Section 148.0033 regarding whether the municipality may meet and
315315 confer under this chapter; or
316316 (3) order a certification election under Section
317317 148.0032 to determine whether the employee groups in the meet and
318318 confer team represent a majority of the covered police officers.
319319 (b) If the governing body of a municipality orders a
320320 certification election under Subsection (a)(3) and the employee
321321 groups that are part of the meet and confer team are certified to
322322 represent a majority of the covered police officers, the governing
323323 body shall, not later than the 30th day after the date that results
324324 of that election are certified:
325325 (1) grant recognition of the meet and confer team as
326326 requested in the petition for recognition and determine by majority
327327 vote that the municipality may meet and confer under this chapter
328328 without conducting an election by the voters in the municipality
329329 under Section 148.0033; or
330330 (2) defer granting recognition of the meet and confer
331331 team and order an election by the voters in the municipality under
332332 Section 148.0033 regarding whether a public employer may meet and
333333 confer under this chapter.
334334 Sec. 148.0032. CERTIFICATION ELECTION. (a) Except as
335335 provided by Subsection (b), a certification election ordered under
336336 Section 148.0031(a)(3) to determine whether the employee groups in
337337 the meet and confer team represent a majority of the covered police
338338 officers shall be conducted according to procedures agreeable to
339339 the parties.
340340 (b) If the parties are unable to agree on procedures for the
341341 certification election, either party may request the American
342342 Arbitration Association to conduct the election and to certify the
343343 results of the election.
344344 (c) Certification of the results of an election under this
345345 section resolves the question concerning representation.
346346 (d) Each employee group in the meet and confer team is
347347 liable for the expenses of the certification election for the
348348 employees the group represents.
349349 Sec. 148.0033. ELECTION TO AUTHORIZE OPERATING UNDER THIS
350350 CHAPTER. (a) The governing body of a municipality that receives a
351351 petition for recognition under Section 148.0031 may order an
352352 election to determine whether a public employer may meet and confer
353353 under this chapter.
354354 (b) An election ordered under this section must be held as
355355 part of the next regularly scheduled general election for municipal
356356 officials that is held after the date the governing body of the
357357 municipality orders the election and that allows sufficient time to
358358 prepare the ballot in compliance with other requirements of law.
359359 (c) The ballot for an election ordered under this section
360360 shall be printed to permit voting for or against the proposition:
361361 "Authorizing __________ (name of the municipality) to operate under
362362 the state law allowing a municipality to meet and confer and make
363363 agreements with the meet and confer team representing municipal
364364 police officers as provided by state law, preserving the
365365 prohibition against strikes and organized work stoppages, and
366366 providing penalties for strikes and organized work stoppages."
367367 (d) An election called under this section must be held and
368368 the returns prepared and canvassed in conformity with the Election
369369 Code.
370370 (e) If an election authorized under this section is held,
371371 the municipality may operate under the other provisions of this
372372 chapter only if a majority of the votes cast at the election favor
373373 the proposition.
374374 (f) If an election authorized under this section is held, a
375375 meet and confer team may not submit a petition for recognition to
376376 the governing body of the municipality under Section 148.0031
377377 before the second anniversary of the date of the election.
378378 Sec. 148.0034. WITHDRAWAL OF RECOGNITION. (a) The police
379379 officers may withdraw the recognition of the meet and confer team
380380 granted under this chapter by filing with the governing body of the
381381 municipality a petition signed by a majority of all covered police
382382 officers.
383383 (b) The governing body of the municipality may:
384384 (1) withdraw recognition as provided by the petition;
385385 or
386386 (2) order a certification election in accordance with
387387 Section 148.0032 regarding whether to do so.
388388 Sec. 148.0035. RECOGNITION OF MEET AND CONFER TEAM. (a) A
389389 public employer in a municipality that chooses to meet and confer
390390 under this chapter shall recognize the meet and confer team that is
391391 recognized under Section 148.0031 or 148.0033 as the sole and
392392 exclusive bargaining agent for the police officers, excluding the
393393 head of the police department and the employees exempt under
394394 Subsection (b), in accordance with this chapter and the petition.
395395 (b) For the purposes of Subsection (a), exempt employees are
396396 employees appointed by the head of the police department in the
397397 classification immediately below that of department head or that
398398 are exempt by the mutual agreement of the meet and confer team and
399399 the municipality.
400400 (c) The municipality shall recognize the meet and confer
401401 team until recognition of the meet and confer team is withdrawn in
402402 accordance with Section 148.0034 by a majority of the police
403403 officers who are eligible to sign a petition for recognition.
404404 Sec. 148.004. GENERAL PROVISIONS RELATING TO AGREEMENTS,
405405 RECOGNITION, AND STRIKES. (a) A municipality may not be denied
406406 local control over the wages, salaries, rates of pay, hours of work,
407407 and other terms of employment, or other state-mandated personnel
408408 issues, if the municipality and the meet and confer team recognized
409409 under Section 148.0031 or 148.0033 as the sole and exclusive
410410 bargaining agent for the covered police officers come to a mutual
411411 agreement on any of the terms of employment. If an agreement is not
412412 reached, the state laws, local ordinances, and civil service rules
413413 remain unaffected. All agreements shall be written. Nothing in
414414 this chapter requires either party to meet and confer on any issue
415415 or reach an agreement.
416416 (b) A municipality may meet and confer only if the meet and
417417 confer team does not advocate the illegal right to strike by public
418418 employees.
419419 (c) Police officers of a municipality may not engage in
420420 strikes against this state or a political subdivision of this
421421 state. A police officer who participates in a strike forfeits all
422422 civil service rights, reemployment rights, and any other rights,
423423 benefits, or privileges the police officer enjoys as a result of
424424 employment or prior employment.
425425 (d) In this section, "strike" means failing to report for
426426 duty in concerted action with others, wilfully being absent from an
427427 assigned position, stopping work, abstaining from the full,
428428 faithful, and proper performance of the duties of employment, or
429429 interfering with the operation of a municipality. However, this

433433 Sec. 148.005. PAYROLL DUES DEDUCTIONS. The municipality
434434 may not prevent automatic payroll deductions for dues paid to a
435435 police officer employee group.
436436 Sec. 148.006. RECORDS AND MEETINGS. (a) An agreement made
437437 under this chapter is public information for purposes of Chapter
438438 552, Government Code. The agreement and any document prepared and
439439 used by the municipality in connection with the agreement, except
440440 for materials created during a municipality's caucuses and notes
441441 that are otherwise privileged by law, are available to the public in
442442 accordance with Chapter 552, Government Code, only after the
443443 agreement is ratified by both parties.
444444 (b) This section does not affect the application of
445445 Subchapter C, Chapter 552, Government Code, to a document prepared
446446 and used by the municipality in connection with the agreement.
447447 Sec. 148.007. ENFORCEABILITY OF AGREEMENT. (a) A written
448448 agreement made under this chapter between a municipality and the
449449 meet and confer team is enforceable and binding on the
450450 municipality, the meet and confer team, police officer employee
451451 groups, and the police officers covered by the agreement if:
452452 (1) the municipality's governing body ratified the
453453 agreement by a majority vote; and
454454 (2) the agreement is ratified under Section 148.008.
455455 (b) A state district court of the judicial district in which
456456 a majority of the population of the municipality is located has full
457457 authority and jurisdiction on the application of either party
458458 aggrieved by an action or omission of the other party when the
459459 action or omission is related to a right, duty, or obligation
460460 provided by any written agreement ratified as required by this
461461 chapter. The court may issue proper restraining orders, temporary
462462 and permanent injunctions, and any other writ, order, or process,
463463 including contempt orders, that are appropriate to enforcing any
464464 written agreement ratified as required by this chapter.
465465 Sec. 148.008. ELECTION TO RATIFY AGREEMENT. (a) The meet
466466 and confer team shall call an election to ratify any agreement
467467 reached with the municipality if the agreement has been approved by
468468 a unanimous vote of the members of the meet and confer team.
469469 (b) All police officers of the municipality are eligible to
470470 vote in the election.
471471 (c) An agreement may be ratified under this section only if
472472 at least 50 percent of the votes cast in the election favor the
473473 ratification.
474474 (d) A police officer who is not a member of a police officer
475475 employee group may be assessed a fee for any cost associated with
476476 casting the police officer's vote.
477477 (e) The meet and confer team shall establish procedures for
478478 the election by unanimous consensus.
479479 Sec. 148.009. ACTION OR ELECTION TO REPEAL AUTHORIZATION TO
480480 OPERATE UNDER THIS CHAPTER. (a) The governing body of a
481481 municipality that granted recognition of a meet and confer team
482482 under Section 148.0031 without conducting an election under Section
483483 148.0033 may withdraw recognition of the meet and confer team by
484484 providing to the meet and confer team not less than 90 days' written
485485 notice that:
486486 (1) the governing body is withdrawing recognition of
487487 the meet and confer team; and
488488 (2) any agreement between the governing body and the
489489 meet and confer team will not be renewed.
490490 (b) The governing body of a municipality that granted
491491 recognition of a meet and confer team after conducting an election
492492 under Section 148.0033 may order an election to determine whether a
493493 public employer may continue to meet and confer under this chapter.
494494 The governing body may not order an election under this subsection
495495 until the second anniversary of the date of the election under
496496 Section 148.0033.
497497 (c) An election ordered under Subsection (b) must be held as
498498 part of the next regularly scheduled general election for municipal
499499 officers that occurs after the date the governing body of the
500500 municipality orders the election and that allows sufficient time to
501501 prepare the ballot in compliance with other requirements of law.
502502 (d) The ballot for an election ordered under Subsection (b)
503503 shall be printed to allow voting for or against the proposition:
504504 "Authorizing __________ (name of the municipality) to continue to
505505 operate under the state law allowing a municipality to meet and
506506 confer and make agreements with the meet and confer team
507507 representing municipal police officers as provided by state law,
508508 preserving the prohibition against strikes and organized work
509509 stoppages, and providing penalties for strikes and organized work
510510 stoppages."
511511 (e) An election ordered under Subsection (b) must be held
512512 and the returns prepared and canvassed in conformity with the
513513 Election Code.
514514 (f) If an election ordered under Subsection (b) is held, the
515515 municipality may continue to operate under this chapter only if a
516516 majority of the votes cast at the election favor the proposition.
517517 (g) If an election ordered under Subsection (b) is held, a
518518 meet and confer team may not submit a petition for recognition to
519519 the governing body of the municipality under Section 148.0031
520520 before the second anniversary of the date of the election.
521521 Sec. 148.010. ELECTION TO REPEAL AGREEMENT. (a) Not later
522522 than the 60th day after the date a meet and confer agreement is
523523 ratified by the governing body of the municipality and the police
524524 officers under Section 148.008, a petition calling for the repeal
525525 of the agreement signed by a number of registered voters residing in
526526 the municipality equal to at least 10 percent of the votes cast at
527527 the most recent general election held in the municipality may be
528528 presented to the person charged with ordering an election under
529529 Section 3.004, Election Code.
530530 (b) If a petition is presented under Subsection (a), the
531531 governing body of the municipality shall:
532532 (1) repeal the meet and confer agreement; or
533533 (2) certify that the governing body is not repealing
534534 the agreement and call an election to determine whether to repeal
535535 the agreement.
536536 (c) An election called under Subsection (b)(2) may be held
537537 as part of the next regularly scheduled general election for the
538538 municipality. The ballot shall be printed to provide for voting for
539539 or against the proposition: "Repeal the meet and confer agreement
540540 ratified on __________ (date agreement was ratified) by the
541541 __________ (name of the governing body of the municipality) and the
542542 police officers employed by the City of __________ (name of
543543 municipality) concerning wages, salaries, rates of pay, hours of
544544 work, and other terms of employment."
545545 (d) If a majority of the votes cast at the election favor the
546546 repeal of the agreement, the agreement is void.
547547 Sec. 148.011. EFFECT ON EXISTING BENEFITS AND RIGHTS. (a)
548548 This chapter may not be construed to repeal any existing benefit
549549 provided by statute or ordinance concerning police officers'
550550 compensation, pensions, retirement plans, hours of work,
551551 conditions of employment, or other emoluments except as expressly
552552 provided in a ratified meet and confer agreement. This chapter is
553553 in addition to the benefits provided by existing statutes and
554554 ordinances.
555555 (b) This chapter may not be construed to interfere with the
556556 free speech right, guaranteed by the First Amendment to the United
557557 States Constitution, of an individual police officer to endorse or
558558 dissent from any agreement.
559559 SECTION 17. Sections 147.002(3) and (4), Local Government
560560 Code, are repealed.
561561 SECTION 18. This Act takes effect September 1, 2015.
