55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to limiting certain state-required assessment instruments
88 administered to public school students in certain grades to
99 assessments required by federal law.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.023(a), Education Code, as effective
1212 until on or before September 1, 2015, is amended to read as follows:
1313 (a) The agency shall adopt or develop appropriate
1414 criterion-referenced assessment instruments designed to assess
1515 essential knowledge and skills in subjects for which assessment is
1616 required by federal law [reading, writing, mathematics, social
1717 studies, and science]. Except as provided by Subsection (a-2), all
1818 students, other than students assessed under Subsection (b) or (l)
1919 or exempted under Section 39.027, shall be assessed in[:
2020 [(1) mathematics, annually in grades three through
2121 seven without the aid of technology and in grade eight with the aid
2222 of technology on any assessment instrument that includes algebra;
2323 [(2) reading, annually in grades three through eight;
2424 [(3) writing, including spelling and grammar, in
2525 grades four and seven;
2626 [(4) social studies, in grade eight;
2727 [(5) science, in grades five and eight; and
2828 [(6)] any [other] subject and grade required by
2929 federal law.
3030 SECTION 2. Section 39.023(a), Education Code, as effective
3131 on or before September 1, 2015, is amended to read as follows:
3232 (a) The agency shall adopt or develop appropriate
3333 criterion-referenced assessment instruments designed to assess
3434 essential knowledge and skills in subjects for which assessment is
3535 required by federal law [reading, writing, mathematics, social
3636 studies, and science]. Except as provided by Subsection (a-2), all
3737 students, other than students assessed under Subsection (b) or (l)
3838 or exempted under Section 39.027, shall be assessed in any subject
3939 and grade required by federal law[:
4040 [(1) mathematics, in grades three and five without the
4141 aid of technology and in grade eight with the aid of technology on
4242 any assessment instrument that includes algebra;
4343 [(2) reading, in grades three, five, and eight;
4444 [(3) writing, including spelling and grammar, in
4545 grades four and seven;
4646 [(4) social studies, in grade eight; and
4747 [(5) science, in grades five and eight].
4848 SECTION 3. Section 39.023(a), Education Code, as effective
4949 September 1, 2017, is amended to read as follows:
5050 (a) The agency shall adopt or develop appropriate
5151 criterion-referenced assessment instruments designed to assess
5252 essential knowledge and skills in subjects for which assessment is
5353 required by federal law [reading, writing, mathematics, social
5454 studies, and science]. Except as provided by Subsection (a-2), all
5555 students, other than students assessed under Subsection (b) or (l)
5656 or exempted under Section 39.027, shall be assessed in[:
5757 [(1) mathematics, annually in grades three through
5858 seven without the aid of technology and in grade eight with the aid
5959 of technology on any assessment instrument that includes algebra;
6060 [(2) reading, annually in grades three through eight;
6161 [(3) writing, including spelling and grammar, in
6262 grades four and seven;
6363 [(4) social studies, in grade eight;
6464 [(5) science, in grades five and eight; and
6565 [(6)] any [other] subject and grade required by
6666 federal law.
6767 SECTION 4. This Act applies beginning with the 2015-2016
6868 school year.
6969 SECTION 5. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2015.
