| 13 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 14 | 9 | SECTION 1. Section 341.064, Health and Safety Code, is | |
| 15 | 10 | amended by adding Subsection (l-1) to read as follows: | |
| 16 | 11 | (l-1) Rules adopted under this chapter may not prohibit the | |
| 17 | 12 | consumption of food or beverages in a public swimming pool that is | |
| 18 | 13 | privately owned and operated. | |
| 19 | 14 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 15 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 16 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 17 | Act does not receive the vote necessary for immediate effect, this | |
