75 relating to the border commerce coordinator.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 772.010, Government Code, as added by
108 Chapter 1339 (H.B. 564), Acts of the 76th Legislature, Regular
119 Session, 1999, is reenacted and amended to read as follows:
1210 Sec. 772.010. BORDER COMMERCE COORDINATOR. (a) The
1311 governor shall designate a border commerce coordinator in the
1412 governor's office or the office of the secretary of state as
1513 determined by the governor. The coordinator shall:
1614 (1) examine trade issues between the United States,
1715 Mexico, and Canada;
1816 (2) act as an ombudsman for government agencies within
1917 the Texas and Mexico border region to help reduce regulations by
2018 improving communication and cooperation between federal, state,
2119 and local governments;
2220 (3) work with federal officials to resolve
2321 transportation issues involving infrastructure, including roads
2422 and bridges, to allow for the efficient movement of goods and people
2523 across the border between Texas and Mexico;
2624 (4) work with federal officials to create a unified
2725 federal agency process to streamline border crossing needs;
2826 (5) work to increase funding for the North American
2927 Development Bank to assist in the financing of water and wastewater
3028 facilities; [and]
3129 (6) explore the sale of excess electric power from
3230 Texas to Mexico;
3331 (7) study the flow of commerce at ports of entry
3432 between this state and Mexico, including the movement of commercial
3533 vehicles across the border, and establish a plan to aid that
3634 commerce and improve the movement of those vehicles;
3735 (8) work to identify problems associated with border
3836 truck inspections and related trade and transportation
3937 infrastructure and develop recommendations for addressing those
4038 problems;
4139 (9) work with the appropriate state and federal
4240 agencies to develop initiatives to mitigate congestion at ports of
4341 entry; and
4442 (10) develop recommendations designed to:
4543 (A) increase trade by attracting new business
4644 ventures;
4745 (B) support expansion of existing and new
4846 industries; and
4947 (C) address workforce training needs.
5048 (b) The governor shall appoint a border commerce
5149 coordinator to serve at the will of the governor in the governor's
5250 office or in the office of the secretary of state and may select the
5351 secretary of state as the coordinator.
5452 (c) The coordinator shall work with the interagency work
5553 group established under Section 772.011, with local governments,
5654 metropolitan planning organizations, and other appropriate
5755 community organizations adjacent to the border of this state with
5856 Mexico, and with comparable entities in Mexican states adjacent to
5957 that border to address the unique planning and capacity needs of
6058 those areas. The coordinator shall assist those governments,
6159 organizations, and entities to identify and develop initiatives to
6260 address those needs. Before January 1 of each year, the coordinator
6361 shall submit to the presiding officer of each house of the
6462 legislature a report of the coordinator's activities under this
6563 subsection during the preceding year.
6664 (d) The coordinator shall:
6765 (1) work with private industry and appropriate
6866 entities of Texas and the United States to require that low-sulfur
6967 fuel be sold along highways in Texas carrying increased traffic
7068 related to activities under the North American Free Trade
7169 Agreement; and
7270 (2) work with representatives of the government of
7371 Mexico and the governments of Mexican states bordering Texas to
7472 increase the use of low-sulfur fuel.
7573 (e) The coordinator shall appoint a border mayor task force,
7674 to be named the Texas Good Neighbor Committee, consisting of the
7775 mayors from every municipality located in this state along the
7876 border between Texas and Mexico that has an adjoining sister city in
7977 Mexico. The task force shall:
8078 (1) advise the coordinator on key trade, security, and
8179 transportation-related issues important to the municipalities
8280 appointed to the task force;
8381 (2) hold quarterly meetings with mayors from Mexico
8482 to:
8583 (A) increase:
8684 (i) cooperation;
8785 (ii) communication; and
8886 (iii) the flow of information;
8987 (B) identify problems; and
9088 (C) recommend solutions;
9189 (3) seek assistance and input from private sector
9290 stakeholders involved in commerce to identify issues to address;
9391 and
9492 (4) provide recommendations to assist the coordinator
9593 in carrying out the coordinator's statutory duties.
9694 SECTION 2. (a) Section 772.010, Government Code, as added
9795 by Chapter 429 (S.B. 1136), Acts of the 76th Legislature, Regular
9896 Session, 1999, is repealed.
9997 (b) Section 3(a), Chapter 1215 (H.B. 925), Acts of the 79th
10098 Legislature, Regular Session, 2005, which reenacted and amended
10199 Section 772.010, Government Code, as added by Chapters 429 (S.B.
102100 1136) and 1339 (H.B. 564), Acts of the 76th Legislature, Regular
103101 Session, 1999, is repealed.
104102 SECTION 3. This Act takes effect immediately if it receives
105103 a vote of two-thirds of all the members elected to each house, as
106104 provided by Section 39, Article III, Texas Constitution. If this
107105 Act does not receive the vote necessary for immediate effect, this
108106 Act takes effect September 1, 2015.
