55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to promoting efficiency in school district administration
88 by limiting, reducing, simplifying, or eliminating certain
99 processes and procedures.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 7.060(a) and (b), Education Code, are
1212 amended to read as follows:
1313 (a) At least once each [even-numbered] year, the
1414 commissioner shall review and, to the greatest extent practicable,
1515 reduce and consolidate written reports and other paperwork,
1616 including surveys, required of a school district by the agency.
1717 (b) The commissioner shall adopt a policy that limits
1818 written reports and other paperwork, including surveys, that a
1919 principal or classroom teacher may be required by the agency to
2020 complete.
2121 SECTION 2. Subchapter C, Chapter 38, Education Code, is
2222 amended by adding Section 38.1045 to read as follows:
2323 Sec. 38.1045. COMMISSIONER REVIEW OF ASSESSMENT
2424 PROCEDURES. The commissioner shall review the procedures for
2525 performing, reporting, and analyzing the results of physical
2626 fitness assessment instruments administered under this subchapter
2727 and develop alternative procedures for simplifying, to the greatest
2828 extent practicable, each stage of the process.
2929 SECTION 3. Subchapter B, Chapter 39, Education Code, is
3030 amended by adding Section 39.0225 to read as follows:
3131 Sec. 39.0225. PERSONNEL FOR ADMINISTRATION OF ASSESSMENT
3232 INSTRUMENTS. Each school district shall review assessment
3333 instrument administration procedures and develop a plan to reduce,
3434 to the greatest extent practicable, the number of personnel used to
3535 administer assessment instruments required under Section 39.023.
3636 SECTION 4. The heading to Section 39.035, Education Code,
3737 is amended to read as follows:
3838 Sec. 39.035. [LIMITATION ON] FIELD TESTING OF ASSESSMENT
3939 INSTRUMENTS PROHIBITED.
4040 SECTION 5. Section 39.035(a), Education Code, is amended to
4141 read as follows:
4242 (a) The [Subject to Subsection (b), the] agency may not
4343 conduct field testing of questions for any assessment instrument
4444 administered under Section 39.023(a), (b), (c), (d), or (l) [that
4545 is separate from the administration of the assessment instrument
4646 not more frequently than every other school year].
4747 SECTION 6. Sections 39.035(b) and (c), Education Code, are
4848 repealed.
4949 SECTION 7. This Act takes effect September 1, 2015.
