No. 1431 A BILL TO BE ENTITLED AN ACT relating to promoting efficiency in school district administration by limiting, reducing, simplifying, or eliminating certain processes and procedures. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Sections 7.060(a) and (b), Education Code, are amended to read as follows: (a) At least once each [even-numbered] year, the commissioner shall review and, to the greatest extent practicable, reduce and consolidate written reports and other paperwork, including surveys, required of a school district by the agency. (b) The commissioner shall adopt a policy that limits written reports and other paperwork, including surveys, that a principal or classroom teacher may be required by the agency to complete. SECTION 2. Subchapter C, Chapter 38, Education Code, is amended by adding Section 38.1045 to read as follows: Sec. 38.1045. COMMISSIONER REVIEW OF ASSESSMENT PROCEDURES. The commissioner shall review the procedures for performing, reporting, and analyzing the results of physical fitness assessment instruments administered under this subchapter and develop alternative procedures for simplifying, to the greatest extent practicable, each stage of the process. SECTION 3. Subchapter B, Chapter 39, Education Code, is amended by adding Section 39.0225 to read as follows: Sec. 39.0225. PERSONNEL FOR ADMINISTRATION OF ASSESSMENT INSTRUMENTS. Each school district shall review assessment instrument administration procedures and develop a plan to reduce, to the greatest extent practicable, the number of personnel used to administer assessment instruments required under Section 39.023. SECTION 4. The heading to Section 39.035, Education Code, is amended to read as follows: Sec. 39.035. [LIMITATION ON] FIELD TESTING OF ASSESSMENT INSTRUMENTS PROHIBITED. SECTION 5. Section 39.035(a), Education Code, is amended to read as follows: (a) The [Subject to Subsection (b), the] agency may not conduct field testing of questions for any assessment instrument administered under Section 39.023(a), (b), (c), (d), or (l) [that is separate from the administration of the assessment instrument not more frequently than every other school year]. SECTION 6. Sections 39.035(b) and (c), Education Code, are repealed. SECTION 7. This Act takes effect September 1, 2015.
