| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter I, Chapter 21, Education Code, is |
|---|
| 15 | 15 | | amended by adding Section 21.4051 to read as follows: |

| 16 | 16 | | Sec. 21.4051. TIME AND FACILITIES FOR EXPRESSING BREAST |
|---|
| 17 | 17 | | MILK. A school district must: |
|---|
| 18 | 18 | | (1) provide a reasonable amount of break time at |
|---|
| 19 | 19 | | appropriate intervals to accommodate an educator desiring to |
|---|
| 20 | 20 | | express breast milk for a child of the educator who is under one |
|---|
| 21 | 21 | | year of age; and |
|---|
| 22 | 22 | | (2) provide a room or other location in close |
|---|
| 23 | 23 | | proximity to the educator's work area, other than a toilet stall or |
|---|
| 24 | 24 | | restroom, with an accessible electrical outlet and a locking door |
|---|
| 25 | 25 | | where the educator can express breast milk in private. |
|---|
| 26 | 26 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 27 | 27 | | school year. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2015. |
