| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 316.094, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 316.094. ALLOCATION OF CERTAIN AMOUNTS TRANSFERRED TO |
|---|
| 13 | 13 | | STATE HIGHWAY FUND. (a) The Texas Department of Transportation |
|---|
| 14 | 14 | | shall designate a highway that is part of the state highway system |
|---|
| 15 | 15 | | as a corridor of commerce if the department determines that the |
|---|
| 16 | 16 | | highway: |
|---|
| 17 | 17 | | (1) is essential to the movement of long-distance |
|---|
| 18 | 18 | | freight; |
|---|
| 19 | 19 | | (2) improves access to ports and other strategic modes |
|---|
| 20 | 20 | | of transportation for the movement of freight; and |
|---|
| 21 | 21 | | (3) connects a large metropolitan area to this state's |
|---|
| 22 | 22 | | border with another state or the United Mexican States. |
|---|
| 23 | 23 | | (b) Of the amounts [Amounts] transferred to the state |
|---|
| 24 | 24 | | highway fund under Section 49-g(c), Article III, Texas |
|---|
| 25 | 25 | | Constitution: |
|---|
| 26 | 26 | | (1) 75 percent, when appropriated, must be used and |
|---|
| 27 | 27 | | allocated throughout the state by the Texas Department of |
|---|
| 28 | 28 | | Transportation consistent with existing formulas adopted by the |
|---|
| 29 | 29 | | Texas Transportation Commission; and |
|---|
| 30 | 30 | | (2) 25 percent, when appropriated, must be used and |
|---|
| 31 | 31 | | allocated by the Texas Department of Transportation for corridors |
|---|
| 32 | 32 | | of commerce designated under Subsection (a). |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2015. |
