66 AN ACT
77 relating to the allocation of certain amounts transferred to the
88 state highway fund to designated corridors of commerce.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 316.094, Government Code, is amended to
1111 read as follows:
1212 Sec. 316.094. ALLOCATION OF CERTAIN AMOUNTS TRANSFERRED TO
1313 STATE HIGHWAY FUND. (a) The Texas Department of Transportation
1414 shall designate a highway that is part of the state highway system
1515 as a corridor of commerce if the department determines that the
1616 highway:
1717 (1) is essential to the movement of long-distance
1818 freight;
1919 (2) improves access to ports and other strategic modes
2020 of transportation for the movement of freight; and
2121 (3) connects a large metropolitan area to this state's
2222 border with another state or the United Mexican States.
2323 (b) Of the amounts [Amounts] transferred to the state
2424 highway fund under Section 49-g(c), Article III, Texas
2525 Constitution:
2626 (1) 75 percent, when appropriated, must be used and
2727 allocated throughout the state by the Texas Department of
2828 Transportation consistent with existing formulas adopted by the
2929 Texas Transportation Commission; and
3030 (2) 25 percent, when appropriated, must be used and
3131 allocated by the Texas Department of Transportation for corridors
3232 of commerce designated under Subsection (a).
3333 SECTION 2. This Act takes effect September 1, 2015.
