 A BILL TO BE ENTITLED
 AN ACT
 relating to the allocation of certain amounts transferred to the
 state highway fund to designated corridors of commerce.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 316.094, Government Code, is amended to
 read as follows:
 Sec. 316.094.  ALLOCATION OF CERTAIN AMOUNTS TRANSFERRED TO
 STATE HIGHWAY FUND.  (a) The Texas Department of Transportation
 shall designate a highway that is part of the state highway system
 as a corridor of commerce if the department determines that the
 highway:
 (1)  is essential to the movement of long-distance
 freight;
 (2)  improves access to ports and other strategic modes
 of transportation for the movement of freight; and
 (3)  connects a large metropolitan area to this state's
 border with another state or the United Mexican States.
 (b)  Of the amounts [Amounts] transferred to the state
 highway fund under Section 49-g(c), Article III, Texas
 Constitution:
 (1)  75 percent, when appropriated, must be used and
 allocated throughout the state by the Texas Department of
 Transportation consistent with existing formulas adopted by the
 Texas Transportation Commission; and
 (2)  25 percent, when appropriated, must be used and
 allocated by the Texas Department of Transportation for corridors
 of commerce designated under Subsection (a).
 SECTION 2.  This Act takes effect September 1, 2015.
