| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 223.001, Transportation Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | Sec. 223.001. CONTRACT REQUIREMENTS [REQUIRING COMPETITIVE | |
| 13 | 13 | BIDS]. (a) Subject to Subsection (b), the [The] department shall | |
| 14 | 14 | submit for competitive bids each contract for: | |
| 15 | 15 | (1) the improvement of a highway that is part of the | |
| 16 | 16 | state highway system; or | |
| 17 | 17 | (2) materials to be used in the construction or | |
| 18 | 18 | maintenance of that highway. | |
| 19 | 19 | (b) The commission shall designate in each fiscal year at | |
| 20 | 20 | least 10 specific highway projects to be completed using the | |
| 21 | 21 | design-build method under Subchapter F. | |
| 22 | 22 | SECTION 2. Section 223.001, Transportation Code, as amended | |
| 23 | 23 | by this Act, applies only to a fiscal year beginning on or after the | |
| 24 | 24 | effective date of this Act. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2015. |
