12	5		AN ACT
13		-	relating to procedures for a ~~municipality~~ to adopt or ~~amend a~~

15	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16	9		SECTION 1. The heading to Section 214.217, Local Government
17	10		Code, is amended to read as follows:
18	11		Sec. 214.217. PROCEDURES FOR [NOTICE REGARDING] MODEL CODE
19		-	ADOPTION OR AMENDMENT [IN CERTAIN MUNICIPALITIES].
	12	+	ADOPTION OR AMENDMENT IN CERTAIN MUNICIPALITIES.
20	13		SECTION 2. Section 214.217, Local Government Code, is
21		-	amended by amending Subsection (e) and adding Subsection (g) to
22		-	read as follows:
	14	+	amended by amending Subsections (b) and (e) and adding Subsection
	15	+	(g) to read as follows:
	16	+	(b) This section applies only to a municipality with a
	17	+	population of more than 40,000 [100,000].
23	18		(e) The [On the written request from five or more persons,
24	19		the] governing body of the municipality shall hold two public
25	20		hearings [a public hearing] open to public comment on the proposed
26	21		adoption of or amendment to a national model code under this
27	22		section. The hearings [hearing] must be held on or before the 14th
28	23		day before the date the governing body adopts the ordinance that
29	24		adopts or amends a national model code under this section.
30	25		(g) Before adopting or amending a national model code, the
31	26		governing body of a municipality must publish a cost-benefit
32	27		analysis of the code or amendment that includes:
33	28		(1) estimations of the code's or amendment's:
34	29		(A) cost to the local economy;
35	30		(B) effect on tax revenue;
36	31		(C) effect on net growth in new development in
37	32		the municipality; and
38	33		(D) additional cost per unit of development in
39	34		each type of zoning use designated by the municipality; and
40	35		(2) for an amendment that addresses existing or
41	36		potential harm to health and safety:
42	37		(A) scientific evidence supporting the
43	38		probability or likelihood that the harm has occurred or will occur;
44	39		and
45	40		(B) scientific evidence supporting the
46	41		probability or likelihood that the amendment will prevent or
47	42		address the harm.
