125 AN ACT
13- relating to procedures for a municipality to adopt or amend a
14- national model building code.
6+ relating to procedures for a certain municipalities to adopt or
7+ amend a national model building code.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. The heading to Section 214.217, Local Government
1710 Code, is amended to read as follows:
1811 Sec. 214.217. PROCEDURES FOR [NOTICE REGARDING] MODEL CODE
19- ADOPTION OR AMENDMENT [IN CERTAIN MUNICIPALITIES].
12+ ADOPTION OR AMENDMENT IN CERTAIN MUNICIPALITIES.
2013 SECTION 2. Section 214.217, Local Government Code, is
21- amended by amending Subsection (e) and adding Subsection (g) to
22- read as follows:
14+ amended by amending Subsections (b) and (e) and adding Subsection
15+ (g) to read as follows:
16+ (b) This section applies only to a municipality with a
17+ population of more than 40,000 [100,000].
2318 (e) The [On the written request from five or more persons,
2419 the] governing body of the municipality shall hold two public
2520 hearings [a public hearing] open to public comment on the proposed
2621 adoption of or amendment to a national model code under this
2722 section. The hearings [hearing] must be held on or before the 14th
2823 day before the date the governing body adopts the ordinance that
2924 adopts or amends a national model code under this section.
3025 (g) Before adopting or amending a national model code, the
3126 governing body of a municipality must publish a cost-benefit
3227 analysis of the code or amendment that includes:
3328 (1) estimations of the code's or amendment's:
3429 (A) cost to the local economy;
3530 (B) effect on tax revenue;
3631 (C) effect on net growth in new development in
3732 the municipality; and
3833 (D) additional cost per unit of development in
3934 each type of zoning use designated by the municipality; and
4035 (2) for an amendment that addresses existing or
4136 potential harm to health and safety:
4237 (A) scientific evidence supporting the
4338 probability or likelihood that the harm has occurred or will occur;
4439 and
4540 (B) scientific evidence supporting the
4641 probability or likelihood that the amendment will prevent or
4742 address the harm.
48- SECTION 3. Section 214.217(b), Local Government Code, is
49- repealed.
50- SECTION 4. This Act takes effect September 1, 2015.
