99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the transfer of certain inmates to the Texas Department
1212 of Criminal Justice following pronouncement of the inmate's
1313 sentence.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 3, Article 42.09, Code of Criminal
1616 Procedure, is amended to read as follows:
1717 Sec. 3. If a defendant [is] convicted of a felony is [and]
1818 sentenced to death or to[,] life[, or a term of more than ten years]
1919 in the Texas Department of Criminal Justice or is ineligible for
2020 release on bail pending appeal under Article 44.04(b) and [he]
2121 gives notice of appeal, the defendant [he] shall be transferred to
2222 the department on a commitment pending a mandate from the court of
2323 appeals or the Court of Criminal Appeals.
2424 SECTION 2. This Act takes effect September 1, 2015.
