44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to rules which insure that local independent school
77 district selection of non-state adopted instructional materials to
88 be purchased with state funds, is as accountable and transparent as
99 the State Board of Education approval process for state-adopted
1010 instruction materials.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 31.003, Education Code, is amended by
1313 designating the current rule as Subsection (a) and adding
1414 Subsections (b), (b-1), (b-2), (b-3), (b-4), (b-5), and (b-6)
1515 to read as follows:
1616 (a) The State Board of Education may adopt rules, consistent
1717 with this chapter, for the adoption, requisition,
1818 distribution, care, use, and disposal of instructional
1919 materials.
2020 (b) The state Board of Education may by rule set minimum
2121 standards for local procedures selecting non-state adopted
2222 instructional materials to be purchased with state funds only
2323 in the areas of:
2424 (1)public notice, access, and input;
2525 (2) review by independent panel to determine coverage
2626 of the essential knowledge and skills;
2727 (3) prevention/correction of factual errors;
2828 (4)coverage of essential knowledge and skills in the
2929 student version as well as in the teacher version of
3030 instructional materials, pursuant to TEC 31.023(a);
3131 (5) compliance with the stated purpose of TEC
3232 28.002(h); and
3333 (6)safeguards against corruption.
3434 SECTION 2. This Act takes effect immediately if it
3535 receives a vote of two-thirds of all the members elected
3636 to each house, as provided by Section 39, Article III,
3737 Texas Constitution. If this Act does not receive the
3838 vote necessary for immediate effect, this Act takes
3939 effect September 1, 2015.
