66 AN ACT
77 relating to programs for imposing or increasing a toll on and
88 increasing the vehicle registration fee for a commercial motor
99 vehicle.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter H, Chapter 201, Transportation Code,
1212 is amended by adding Section 201.623 to read as follows:
1313 Sec. 201.623. COMMERCIAL MOTOR VEHICLE TOLL PROGRAM. (a)
1414 Notwithstanding any other law, the department, in consultation with
1515 the comptroller, may establish a program for imposing a toll or
1616 increasing an existing toll on a commercial motor vehicle for the
1717 use of a state highway.
1818 (b) The department must hold a public hearing before
1919 imposing or increasing a toll under the program.
2020 (c) Toll revenue collected or received by the department
2121 under the program must be deposited to the credit of the state
2222 highway fund.
2323 SECTION 2. Subchapter G, Chapter 502, Transportation Code,
2424 is amended by adding Section 502.360 to read as follows:
2525 Sec. 502.360. ADDITIONAL FEE FOR COMMERCIAL MOTOR VEHICLE.
2626 (a) Notwithstanding any other law, the department, in consultation
2727 with the comptroller, may establish a program for imposing an
2828 additional fee for the registration of a commercial motor vehicle.
2929 (b) The department must hold a public hearing before
3030 imposing an additional fee under the program.
3131 (c) An additional fee imposed under the program may not be
3232 more than 50 percent of the applicable fee for the vehicle under
3333 Subchapter F.
3434 (d) Registration fees collected under the program must be
3535 deposited to the credit of the state highway fund.
3636 SECTION 3. This Act takes effect September 1, 2015.
