 A BILL TO BE ENTITLED
 AN ACT
 relating to programs for imposing or increasing a toll on and
 increasing the vehicle registration fee for a commercial motor
 vehicle.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter H, Chapter 201, Transportation Code,
 is amended by adding Section 201.623 to read as follows:
 Sec. 201.623.  COMMERCIAL MOTOR VEHICLE TOLL PROGRAM. (a)
 Notwithstanding any other law, the department, in consultation with
 the comptroller, may establish a program for imposing a toll or
 increasing an existing toll on a commercial motor vehicle for the
 use of a state highway.
 (b)  The department must hold a public hearing before
 imposing or increasing a toll under the program.
 (c)  Toll revenue collected or received by the department
 under the program must be deposited to the credit of the state
 highway fund.
 SECTION 2.  Subchapter G, Chapter 502, Transportation Code,
 is amended by adding Section 502.360 to read as follows:
 Sec. 502.360.  ADDITIONAL FEE FOR COMMERCIAL MOTOR VEHICLE.
 (a) Notwithstanding any other law, the department, in consultation
 with the comptroller, may establish a program for imposing an
 additional fee for the registration of a commercial motor vehicle.
 (b)  The department must hold a public hearing before
 imposing an additional fee under the program.
 (c)  An additional fee imposed under the program may not be
 more than 50 percent of the applicable fee for the vehicle under
 Subchapter F.
 (d)  Registration fees collected under the program must be
 deposited to the credit of the state highway fund.
 SECTION 3.  This Act takes effect September 1, 2015.
