A BILL TO BE ENTITLED
AN ACT
relating to the establishment of an infrastructure improvement
council by the Rio Grande Regional Water Authority.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 1.01, Chapter 385, Acts of the 78th
Legislature, Regular Session, 2003, is amended by adding
Subdivision (4-b) to read as follows:
(4-b) "Council" means the council established under
Section 1B.01 of this Act.
SECTION 2. Chapter 385, Acts of the 78th Legislature,
Regular Session, 2003, is amended by adding Article IB to read as
follows:
ARTICLE IB. INFRASTRUCTURE IMPROVEMENT COUNCIL
Sec. 1B.01. INFRASTRUCTURE IMPROVEMENT COUNCIL. (a) The
board shall establish an infrastructure improvement council in
connection with the implementation of infrastructure improvement
projects within the authority's territory. The board shall appoint
to the council only those members of the conference who pay to the
council the annual voluntary assessment under Section 1B.02.
(b) The council shall provide financial assistance, as
available, to implement infrastructure improvement projects under
this article. To be eligible for financial assistance from the
council, a project must be approved by a majority of the council
members voting on that project.
Sec. 1B.02. INFRASTRUCTURE IMPROVEMENT ASSESSMENT. The
board shall establish and determine the amount of an annual
voluntary assessment that may be paid to the council by members of
the conference. The money from the assessment may be used to
provide financial assistance for an infrastructure improvement
project under this article if the project is approved by a vote of
the council.
SECTION 3. This Act takes effect September 1, 2015.
