75 relating to disclosures on selection or modification of an account
86 by a customer of a financial institution.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 113.053, Estates Code, is amended to
119 read as follows:
1210 Sec. 113.053. REQUIRED DISCLOSURE; USE OF FORM[;
1311 DISCLOSURE]. (a) A financial institution shall disclose the
1412 information provided in this subchapter to a customer at the time
1513 the customer selects or modifies an account. A financial
1614 institution is considered to have [adequately] disclosed the
1715 information provided in this subchapter if:
1816 (1) the financial institution uses the form provided
1917 by Section 113.052; and
2018 (2) the customer places the customer's initials to the
2119 right of each paragraph of the form.
2220 (b) If a financial institution varies the format of the form
2321 provided by Section 113.052, the financial institution may make
2422 disclosures in the account agreement or in any other form that
2523 [adequately] discloses the information provided by this
2624 subchapter. Disclosures under this subsection must:
2725 (1) be given separately from other account
2826 information;
2927 (2) be provided before account selection or
3028 modification;
3129 (3) be printed in 14-point boldfaced type; and
3230 (4) if the discussions that precede the account
3331 opening or modification are conducted primarily in a language other
3432 than English, be in that language.
3533 (c) The financial institution shall notify the customer of
3634 the type of account the customer selected [If the customer receives
3735 adequate disclosure of the ownership rights to an account and the
3836 names of the parties are appropriately indicated, a financial
3937 institution may combine any of the provisions in, and vary the
4038 format of, the form and notices described in Section 113.052 in:
4139 [(1) a universal account form with options listed for
4240 selection and additional disclosures provided in the account
4341 agreement; or
4442 [(2) any other manner that adequately discloses the
4543 information provided by this subchapter].
4644 (d) This section does not apply to a credit union.
4745 SECTION 2. Subchapter B, Chapter 113, Estates Code, is
4846 amended by adding Section 113.0531 to read as follows:
4947 Sec. 113.0531. USE OF FORM AND DISCLOSURE BY CREDIT UNIONS.
5048 (a) A credit union is considered to have disclosed the information
5149 provided by this subchapter if the credit union uses the form
5250 provided by Section 113.052.
5351 (b) If a credit union varies the format of the form provided
5452 by Section 113.052, the credit union may make disclosures in the
5553 account agreement or in any other form that discloses the
5654 information provided by this subchapter.
5755 (c) If the customer receives disclosure of the ownership
5856 rights to an account and the names of the parties are indicated, a
5957 credit union may combine any of the provisions in, and vary the
6058 format of, the form and notices described in Section 113.052 in:
6159 (1) a universal account form with options listed for
6260 selection and additional disclosures provided in the account
6361 agreement; or
6462 (2) any other manner that adequately discloses the
6563 information provided by this subchapter.
6664 SECTION 3. This Act applies only to an account created or
6765 modified on or after the effective date of this Act. An account
6866 created or modified before the effective date of this Act is
6967 governed by the law in effect when the account was created or
7068 modified, and the former law is continued in effect for that
7169 purpose.
7270 SECTION 4. This Act takes effect September 1, 2015.
