| 12 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 9 | | SECTION 1. Section 39.053, Education Code, is amended by |
|---|
| 14 | 10 | | adding Subsection (g-2) to read as follows: |
|---|
| 15 | 11 | | (g-2) In computing completion rates under Subsection |
|---|
| 16 | 12 | | (c)(2), the commissioner shall exclude students who: |
|---|
| 17 | 13 | | (1) are at least 18 years of age as of September 1 of |
|---|
| 18 | 14 | | the school year as reported for the fall semester Public Education |
|---|
| 19 | 15 | | Information Management System (PEIMS) submission and have |
|---|
| 20 | 16 | | satisfied the credit requirements for high school graduation; |
|---|
| 21 | 17 | | (2) have not completed their individualized education |
|---|
| 22 | 18 | | program under 19 T.A.C. Section 89.1070(b)(2) and the Individuals |
|---|
| 23 | 19 | | with Disabilities Education Act (20 U.S.C. Section 1400 et seq.); |
|---|
| 24 | 20 | | and |
|---|
| 25 | 21 | | (3) are enrolled and receiving individualized |
|---|
| 26 | 22 | | education program services. |
|---|
| 27 | 23 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 28 | 24 | | school year. |
|---|
| 29 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 29 | | Act takes effect September 1, 2015. |
