84 AN ACT
95 relating to excluding certain adult students receiving special
106 education services from computation of completion rates for
117 purposes of public school accountability.
128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
139 SECTION 1. Section 39.053, Education Code, is amended by
1410 adding Subsection (g-2) to read as follows:
1511 (g-2) In computing completion rates under Subsection
1612 (c)(2), the commissioner shall exclude students who:
1713 (1) are at least 18 years of age as of September 1 of
1814 the school year as reported for the fall semester Public Education
1915 Information Management System (PEIMS) submission and have
2016 satisfied the credit requirements for high school graduation;
2117 (2) have not completed their individualized education
2218 program under 19 T.A.C. Section 89.1070(b)(2) and the Individuals
2319 with Disabilities Education Act (20 U.S.C. Section 1400 et seq.);
2420 and
2521 (3) are enrolled and receiving individualized
2622 education program services.
2723 SECTION 2. This Act applies beginning with the 2015-2016
2824 school year.
2925 SECTION 3. This Act takes effect immediately if it receives
3026 a vote of two-thirds of all the members elected to each house, as
3127 provided by Section 39, Article III, Texas Constitution. If this
3228 Act does not receive the vote necessary for immediate effect, this
3329 Act takes effect September 1, 2015.
