| 16 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 17 | 17 | | SECTION 1. Section 12.106, Education Code, is amended by |
|---|
| 18 | 18 | | adding Subsection (d) to read as follows: |
|---|
| 19 | 19 | | (d) In addition to other amounts provided by this section, a |
|---|
| 20 | 20 | | charter holder is entitled to receive for the open-enrollment |
|---|
| 21 | 21 | | charter school funding per student in average daily attendance in |
|---|
| 22 | 22 | | an amount equal to the state average amount of revenue per student |
|---|
| 23 | 23 | | in average daily attendance collected by independent school |
|---|
| 24 | 24 | | districts under Sections 46.003(a) and 46.032(a). |

| 25 | 25 | | SECTION 2. Section 12.106(d), Education Code, as added by |
|---|
| 26 | 26 | | this Act, applies to funding per student in average daily |
|---|
| 27 | 27 | | attendance at an open-enrollment charter school for the 2015-2016 |
|---|
| 28 | 28 | | and 2016-2017 school years only if the 84th Legislature makes a |
|---|
| 29 | 29 | | specific appropriation to implement that provision. |

| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2015. |
