114 A BILL TO BE ENTITLED
125 AN ACT
136 relating to immunity from liability for public and open-enrollment
147 charter school campuses that maintain a supply of epinephrine
158 auto-injectors for emergency use.
169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1710 SECTION 1. The heading to Section 38.0151, Education Code,
1811 is amended to read as follows:
1912 Sec. 38.0151. POLICIES FOR CARE OF CERTAIN STUDENTS AT RISK
2013 FOR ANAPHYLAXIS; MAINTENANCE OF EPINEPHRINE AUTO-INJECTOR SUPPLY.
2114 SECTION 2. Section 38.0151, Education Code, is amended by
22- adding Subsections (b-1), (b-2), and (d-1) and amending Subsection
23- (d) to read as follows:

16+ Subsection (d) to read as follows:
2417 (b-1) Each school district and open-enrollment charter
2518 school may maintain at each campus a supply of epinephrine
2619 auto-injectors that may be administered to a person on campus or at
2720 an off-campus school-sanctioned event experiencing an anaphylactic
2821 reaction. For epinephrine auto-injectors to satisfy this
2922 subsection, the auto-injectors may not have expiration dates that
3023 have passed.
3124 (b-2) The administration of an epinephrine auto-injector in
3225 accordance with the requirements of this section does not
3326 constitute the unlawful practice of any health care profession.
3427 (d) This section does not:
3528 (1) waive any [liability or] immunity from liability
3629 of a governmental entity or its officers or employees; [or]
3730 (2) create any liability for or a cause of action
3831 against a governmental entity or its officers or employees;
3932 (3) waive any immunity from liability under Section
4033 74.151, Civil Practice and Remedies Code, including immunity from
4134 liability to which a school district, open-enrollment charter
4235 school, or district or school employee is entitled under that
4336 section for an act associated with the administration of an
4437 epinephrine auto-injector to a person on campus or at an off-campus
4538 school-sanctioned event experiencing an anaphylactic reaction; or
4639 (4) create any liability or standard of care for or a
4740 cause of action against a governmental entity or its officers or
4841 employees who in good faith administer or fail to administer an
4942 epinephrine auto-injector unless the act is wilfully or wantonly
5043 negligent.
5144 (d-1) A person who in good faith prescribes, dispenses, or
5245 administers a non-patient specific epinephrine auto-injector or
5346 provides training, advice, or supervision on the use of an
5447 epinephrine auto-injector is immune from liability in a criminal,
5548 civil, disciplinary, or administrative action, including immunity
5649 from liability for civil damages, resulting from that action or
5750 failure to act.
51+ (f) If a school district or open-enrollment charter school
52+ maintains a supply of epinephrine auto-injectors as provided by
53+ Subsection (b-1), the district or school shall provide written
54+ notice to a parent or guardian of each student enrolled in the
55+ district or school. Notice required under this subsection must be
56+ provided before the district or school obtains a supply of
57+ epinephrine auto-injectors and before the start of each school
58+ year.
5859 SECTION 3. This Act takes effect immediately if it receives
5960 a vote of two-thirds of all the members elected to each house, as
6061 provided by Section 39, Article III, Texas Constitution. If this
6162 Act does not receive the vote necessary for immediate effect, this
6263 Act takes effect September 1, 2015.
