55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the determination of resident status of students by
88 public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.052, Education Code, is amended by
1111 adding Subsection (c) to read as follows:
1212 (c) Notwithstanding any other provision of this section, a
1313 person who is not authorized by law to be present in the United
1414 States may not be considered a resident of this state for purposes
1515 of this title.
1616 SECTION 2. Section 54.055, Education Code, is amended by
1717 adding Subsection (c) to read as follows:
1818 (c) Notwithstanding Subsection (a), an institution of
1919 higher education may not, on the basis of Section 54.052(c),
2020 reclassify as a nonresident of this state a student classified as a
2121 resident under Section 54.052(a)(3) if, not later than the
2222 beginning of the 2015-2016 academic year, the student has completed
2323 at least 30 semester credit hours at an institution of higher
2424 education.
2525 SECTION 3. Except as provided by Section 54.055(c),
2626 Education Code, as added by this Act, a public institution of higher
2727 education in this state may, for any semester or academic term,
2828 before the beginning of that semester or academic term, reclassify
2929 as a nonresident a student previously classified as a resident of
3030 this state by the institution or another public institution of
3131 higher education in this state before the enactment of Section
3232 54.052(c), Education Code, as added by this Act, if the student is
3333 not authorized by law to be present in the United States.
3434 SECTION 4. This Act takes effect September 1, 2015.
