6	4		AN ACT
7	5		relating to the liability of certain social workers who provide
8	6		volunteer health care services to charitable organizations.
9	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	8		SECTION 1. Section 84.003(5), Civil Practice and Remedies
11	9		Code, is amended to read as follows:
12	10		(5) "Volunteer health care provider" means an
13	11		individual who voluntarily provides health care services without
14	12		compensation or expectation of compensation and who is:
15	13		(A) an individual who is licensed to practice
16	14		medicine under Subtitle B, Title 3, Occupations Code;
17	15		(B) a retired physician who is eligible to
18	16		provide health care services, including a retired physician who is
19	17		licensed but exempt from paying the required annual registration
20	18		fee under Section 156.002, Occupations Code;
21	19		(C) a physician assistant licensed under Chapter
22	20		204, Occupations Code, or a retired physician assistant who is
23	21		eligible to provide health care services under the law of this
24	22		state;
25	23		(D) a registered nurse, including an advanced
26	24		nurse practitioner, or vocational nurse, licensed under Chapter
27	25		301, Occupations Code, or a retired vocational nurse or registered
28	26		nurse, including a retired advanced nurse practitioner, who is
29	27		eligible to provide health care services under the law of this
30	28		state;
31	29		(E) a pharmacist licensed under Subtitle J, Title
32	30		3, Occupations Code, or a retired pharmacist who is eligible to
33	31		provide health care services under the law of this state;
34	32		(F) a podiatrist licensed under Chapter 202,
35	33		Occupations Code, or a retired podiatrist who is eligible to
36	34		provide health care services under the law of this state;
37	35		(G) a dentist licensed under Subtitle D, Title 3,
38	36		Occupations Code, or a retired dentist who is eligible to provide
39	37		health care services under the law of this state;
40	38		(H) a dental hygienist licensed under Subtitle D,
41	39		Title 3, Occupations Code, or a retired dental hygienist who is
42	40		eligible to provide health care services under the law of this
43	41		state;
44	42		(I) an optometrist or therapeutic optometrist
45	43		licensed under Chapter 351, Occupations Code, or a retired
46	44		optometrist or therapeutic optometrist who is eligible to provide
47	45		health care services under the law of this state;
48	46		(J) a physical therapist or physical therapist
49	47		assistant licensed under Chapter 453, Occupations Code, or a
50	48		retired physical therapist or physical therapist assistant who is
51	49		eligible to provide health care services under the law of this
52	50		state;
53	51		(K) an occupational therapist or occupational
54	52		therapy assistant licensed under Chapter 454, Occupations Code, or
55	53		a retired occupational therapist or occupational therapy assistant
56	54		who is eligible to provide health care services under the law of
57	55		this state; [or]
58	56		(L) an audiologist, assistant in audiology,
59	57		speech-language pathologist, or assistant in speech-language
60	58		pathology licensed under Chapter 401, Occupations Code, or a
61	59		retired audiologist, assistant in audiology, speech-language
62	60		pathologist, or assistant in speech-language pathology who is
63	61		eligible to provide health care services under the laws of this
64	62		state; or
65	63		(M) a social worker licensed under Chapter 505,
66	64		Occupations Code, or a retired social worker who is eligible to
67	65		engage in the practice of social work under the law of this state.
68	66		SECTION 2. This Act applies only to a cause of action that
69	67		accrues on or after the effective date of this Act. A cause of
70	68		action that accrued before the effective date of this Act is
71	69		governed by the law applicable to the cause of action immediately
72	70		before the effective date of this Act, and that law is continued in
73	71		effect for that purpose.
74	72		SECTION 3. This Act takes effect September 1, 2015.
