64 AN ACT
75 relating to the liability of certain social workers who provide
86 volunteer health care services to charitable organizations.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 84.003(5), Civil Practice and Remedies
119 Code, is amended to read as follows:
1210 (5) "Volunteer health care provider" means an
1311 individual who voluntarily provides health care services without
1412 compensation or expectation of compensation and who is:
1513 (A) an individual who is licensed to practice
1614 medicine under Subtitle B, Title 3, Occupations Code;
1715 (B) a retired physician who is eligible to
1816 provide health care services, including a retired physician who is
1917 licensed but exempt from paying the required annual registration
2018 fee under Section 156.002, Occupations Code;
2119 (C) a physician assistant licensed under Chapter
2220 204, Occupations Code, or a retired physician assistant who is
2321 eligible to provide health care services under the law of this
2422 state;
2523 (D) a registered nurse, including an advanced
2624 nurse practitioner, or vocational nurse, licensed under Chapter
2725 301, Occupations Code, or a retired vocational nurse or registered
2826 nurse, including a retired advanced nurse practitioner, who is
2927 eligible to provide health care services under the law of this
3028 state;
3129 (E) a pharmacist licensed under Subtitle J, Title
3230 3, Occupations Code, or a retired pharmacist who is eligible to
3331 provide health care services under the law of this state;
3432 (F) a podiatrist licensed under Chapter 202,
3533 Occupations Code, or a retired podiatrist who is eligible to
3634 provide health care services under the law of this state;
3735 (G) a dentist licensed under Subtitle D, Title 3,
3836 Occupations Code, or a retired dentist who is eligible to provide
3937 health care services under the law of this state;
4038 (H) a dental hygienist licensed under Subtitle D,
4139 Title 3, Occupations Code, or a retired dental hygienist who is
4240 eligible to provide health care services under the law of this
4341 state;
4442 (I) an optometrist or therapeutic optometrist
4543 licensed under Chapter 351, Occupations Code, or a retired
4644 optometrist or therapeutic optometrist who is eligible to provide
4745 health care services under the law of this state;
4846 (J) a physical therapist or physical therapist
4947 assistant licensed under Chapter 453, Occupations Code, or a
5048 retired physical therapist or physical therapist assistant who is
5149 eligible to provide health care services under the law of this
5250 state;
5351 (K) an occupational therapist or occupational
5452 therapy assistant licensed under Chapter 454, Occupations Code, or
5553 a retired occupational therapist or occupational therapy assistant
5654 who is eligible to provide health care services under the law of
5755 this state; [or]
5856 (L) an audiologist, assistant in audiology,
5957 speech-language pathologist, or assistant in speech-language
6058 pathology licensed under Chapter 401, Occupations Code, or a
6159 retired audiologist, assistant in audiology, speech-language
6260 pathologist, or assistant in speech-language pathology who is
6361 eligible to provide health care services under the laws of this
6462 state; or
6563 (M) a social worker licensed under Chapter 505,
6664 Occupations Code, or a retired social worker who is eligible to
6765 engage in the practice of social work under the law of this state.
6866 SECTION 2. This Act applies only to a cause of action that
6967 accrues on or after the effective date of this Act. A cause of
7068 action that accrued before the effective date of this Act is
7169 governed by the law applicable to the cause of action immediately
7270 before the effective date of this Act, and that law is continued in
7371 effect for that purpose.
7472 SECTION 3. This Act takes effect September 1, 2015.
