88 AN ACT
99 relating to fingerprints collected by the Texas Department of
1010 Public Safety from an applicant for a driver's license or personal
1111 identification certificate and used for the department's image
1212 verification system.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Sections 521.059(a) and (b), Transportation
1515 Code, are amended to read as follows:
1616 (a) The department shall establish an image verification
1717 system based on the following identifiers collected by the
1818 department under Section 521.142(b):
1919 (1) an applicant's facial image; and
2020 (2) an applicant's thumbprints and [or] fingerprints.
2121 (b) The department shall authenticate the facial image,
2222 [and] thumbprints, and [or] fingerprints provided by an applicant
2323 for a personal identification certificate, driver's license, or
2424 commercial driver's license or permit using image comparison
2525 technology to ensure that the applicant:
2626 (1) is issued only one original license, permit, or
2727 certificate;
2828 (2) does not fraudulently obtain a duplicate license,
2929 permit, or certificate; and
3030 (3) does not commit other fraud in connection with the
3131 application for a license, permit, or certificate.
3232 SECTION 2. Section 521.142(b), Transportation Code, is
3333 amended to read as follows:
3434 (b) The application must include:
3535 (1) the thumbprints and [of the applicant or, if
3636 thumbprints cannot be taken, the index] fingerprints of the
3737 applicant;
3838 (2) a photograph of the applicant;
3939 (3) the signature of the applicant; and
4040 (4) a brief description of the applicant.
4141 SECTION 3. This Act takes effect September 1, 2015.
