64 AN ACT
75 relating to the titling, registration, and operation of an
86 autocycle.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Subchapter A, Chapter 501, Transportation Code,
119 is amended by adding Section 501.008 to read as follows:
1210 Sec. 501.008. TITLE FOR AUTOCYCLE. (a) In this section,
1311 "autocycle" means a motor vehicle, other than a tractor, that is:
1412 (1) designed to have when propelled not more than
1513 three wheels on the ground;
1614 (2) equipped with a steering wheel;
1715 (3) equipped with seating that does not require the
1816 operator to straddle or sit astride the seat; and
1917 (4) manufactured and certified to comply with federal
2018 safety requirements for a motorcycle.
2119 (b) For purposes of issuing a title under this chapter, an
2220 autocycle is considered to be a motorcycle.
2321 SECTION 2. Subchapter A, Chapter 502, Transportation Code,
2422 is amended by adding Section 502.004 to read as follows:
2523 Sec. 502.004. REGISTRATION OF AUTOCYCLE. (a) In this
2624 section, "autocycle" means a motor vehicle, other than a tractor,
2725 that is:
2826 (1) designed to have when propelled not more than
2927 three wheels on the ground;
3028 (2) equipped with a steering wheel;
3129 (3) equipped with seating that does not require the
3230 operator to straddle or sit astride the seat; and
3331 (4) manufactured and certified to comply with federal
3432 safety requirements for a motorcycle.
3533 (b) For purposes of registering a vehicle under this
3634 chapter, an autocycle is considered to be a motorcycle.
3735 SECTION 3. Section 521.084, Transportation Code, is amended
3836 to read as follows:
3937 Sec. 521.084. CLASS M LICENSE. A Class M driver's license
4038 authorizes the holder of the license to operate a motorcycle or
4139 moped as defined by Section 541.201.
4240 SECTION 4. Section 521.085(b), Transportation Code, is
4341 amended to read as follows:
4442 (b) Subsection (a) does not prohibit a license holder from
4543 operating a lesser type of vehicle that is a motorcycle described by
4644 Section 521.001(a)(6-a) or an autocycle as defined by Section
4745 501.008.
4846 SECTION 5. Section 545.416, Transportation Code, is amended
4947 by adding Subsection (f) to read as follows:
5048 (f) For purposes of Subsections (c) and (d), an autocycle as
5149 defined by Section 501.008 is considered to be a motorcycle.
5250 SECTION 6. Section 547.617, Transportation Code, is amended
5351 to read as follows:
5452 Sec. 547.617. MOTORCYCLE FOOTRESTS AND HANDHOLDS REQUIRED.
5553 (a) A motorcycle that is designed to carry more than one person
5654 must be equipped with footrests and handholds for use by the
5755 passenger.
5856 (b) This section does not apply to an autocycle as defined
5957 by Section 501.008 or a motorcycle as defined by Section
6058 521.001(a)(6-a).
6159 SECTION 7. Chapter 661, Transportation Code, is amended by
6260 adding Section 661.0015 to read as follows:
6361 Sec. 661.0015. PROTECTIVE HEADGEAR FOR AUTOCYCLE. (a) In
6462 this section, "autocycle" means a motor vehicle, other than a
6563 tractor, that is:
6664 (1) designed to have when propelled not more than
6765 three wheels on the ground;
6866 (2) equipped with a steering wheel;
6967 (3) equipped with seating that does not require the
7068 operator to straddle or sit astride the seat; and
7169 (4) manufactured and certified to comply with federal
7270 safety requirements for a motorcycle.
7371 (b) For purposes of this chapter, an autocycle is considered
7472 to be a motorcycle.
7573 SECTION 8. This Act takes effect immediately if it receives
7674 a vote of two-thirds of all the members elected to each house, as
7775 provided by Section 39, Article III, Texas Constitution. If this
7876 Act does not receive the vote necessary for immediate effect, this
7977 Act takes effect September 1, 2015.
