95 relating to the imposition of the student centers fee at Texas
106 Woman's University.
117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
128 SECTION 1. Section 54.525, Education Code, is amended by
139 amending Subsections (a) and (c) and adding Subsection (d) to read
1410 as follows:
1511 (a) The board of regents of Texas Woman's University may
1612 levy a regular, fixed student fee of not less than $25 or more than
1713 $75 [$40] per student for each semester of the long session and of
1814 not less than $12.50 or more than $35 [$20] per student for each
1915 term of the summer session, as the board determines is just and
2016 necessary for the purpose of financing, improving, operating,
2117 maintaining, and equipping student centers and acquiring or
2218 constructing additions to student centers.
2319 (c) Revenue from a fee imposed under this section shall be
2420 deposited to the credit of an account known as the "Texas Woman's
2521 University Student Center Fee Account" under the control of the
2622 university's student fee advisory committee. Annually, the
2723 committee shall submit to the president of the university its
2824 recommendation for any change to the amount of the fee and a
2925 complete and itemized budget for the student center together with a
3026 complete report of all student center activities conducted during
3127 the past year and all expenditures made in connection with those
3228 activities. The president shall submit the budget to the board of
3329 regents as part of the university's institutional budget. The
3430 board of regents may make changes in the budget that the board
3531 determines are necessary [The board shall keep fees collected under
3632 this section in an account apart from the educational and general
3733 funds of the university. The board shall deposit the fees in a
3834 depository bank designated by the board and shall secure the
3935 deposits as required by law].
4036 (d) Notwithstanding Subsection (a), the board may increase
4137 the amount of the fee for a semester or summer session to an amount
4238 that does not exceed $150 if the increase is approved by a majority
4339 vote of those students participating in a general election called
4440 for that purpose. The increased amount under this subsection may
4541 not be charged after the fifth academic year in which the increased
4642 amount is first charged unless, before the end of that academic
4743 year, the institution has issued bonds payable from the fee, in
4844 which event the increased amount may not be charged after the
4945 academic year in which all such bonds, including refunding bonds
5046 for those bonds, have been fully paid.
5147 SECTION 2. The change in law made by this Act applies only
5248 to fees imposed for a semester or term that begins on or after the
5349 effective date of this Act.
5450 SECTION 3. This Act takes effect immediately if it receives
5551 a vote of two-thirds of all the members elected to each house, as
5652 provided by Section 39, Article III, Texas Constitution. If this
5753 Act does not receive the vote necessary for immediate effect, this
5854 Act takes effect September 1, 2015.
