127 relating to public school performance ratings.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Section 39.054, Education Code, is amended by
1510 amending Subsection (a) and adding Subsection (a-1) to read as
1611 follows:
1712 (a) The commissioner shall adopt rules to evaluate school
1813 district and campus performance and assign each district and campus
19- a performance rating of A, B, C, D, or F. In adopting rules under
20- this subsection, the commissioner shall determine the criteria for
21- each designated letter performance rating. A district or campus
22- performance rating of A reflects exemplary performance. A district
23- or campus performance rating of B reflects recognized performance.
24- A district or campus performance rating of[, B, or] C reflects
25- acceptable performance. A [and a] district or campus performance
26- rating of D or F reflects unacceptable performance. [The
27- commissioner shall also assign each campus a performance rating of
28- exemplary, recognized, acceptable, or unacceptable. A campus
29- performance rating of exemplary, recognized, or acceptable
30- reflects acceptable performance, and a campus performance rating of
31- unacceptable reflects unacceptable performance.] A district may
32- not receive a performance rating of A if the district includes any
33- campus with a performance rating of D or F [unacceptable]. A
34- reference in law to an acceptable rating or acceptable performance
35- includes a performance rating of A or B or exemplary or recognized

3741 (a-1) Not later than August 8 of each year, the performance
38- rating of each district and campus shall be made publicly available
39- as provided by rules adopted under this section [subsection]. If a
40- district or campus received a performance rating of D or F [that
41- reflected unacceptable performance] for the preceding school year,
42- the commissioner shall notify the district of a subsequent such
