55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to criminal offenses involving, and governmental
88 liability for retaliatory prosecutions associated with, the
99 filming, recording, photographing, documenting, or observing of a
1010 peace officer.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Title 5, Civil Practice and Remedies Code, is
1313 amended by adding Chapter 112 to read as follows:
1414 CHAPTER 112. LIABILITY OF GOVERNMENTAL UNIT FOR CERTAIN
1515 UNSUCCESSFUL PROSECUTIONS
1616 Sec. 112.001. DEFINITION. In this chapter, "governmental
1717 unit" has the meaning assigned by Section 101.001.
1818 Sec. 112.002. LIABILITY FOR CERTAIN RETALIATORY
1919 PROSECUTIONS. A person who is prosecuted for an offense under
2020 Section 22.01(a)(1) or 38.15(a)(1), Penal Code, or Section
2121 542.501(a)(1), Transportation Code, and is acquitted of the offense
2222 may recover in a civil action against the governmental unit that
2323 employed any peace officer who accused the person of the offense of
2424 which the person was acquitted if the person shows by a
2525 preponderance of the evidence that:
2626 (1) the person was filming, recording, photographing,
2727 documenting, or observing the peace officer; and
2828 (2) the peace officer's accusation was made in
2929 retaliation for the person's act of filming, recording,
3030 photographing, documenting, or observing the peace officer.
3131 Sec. 112.003. REMEDY. A person who prevails in a suit
3232 against a governmental unit under Section 112.002 is entitled to
3333 recover only the person's reasonable attorney's fees incurred in
3434 connection with the retaliatory prosecution.
3535 Sec. 112.004. SOVEREIGN IMMUNITY WAIVED. Sovereign
3636 immunity to suit and liability is waived and abolished to the extent
3737 of liability created by this chapter.
3838 SECTION 2. Section 22.01, Penal Code, is amended by adding
3939 Subsection (f-1) to read as follows:
4040 (f-1) It is a defense to prosecution under Subsection (a)(1)
4141 that the conduct engaged in by the defendant consisted only of
4242 filming, recording, photographing, documenting, or observing a
4343 peace officer.
4444 SECTION 3. Section 38.15(c), Penal Code, is amended to read
4545 as follows:
4646 (c) It is a defense to prosecution under Subsection (a)(1)
4747 that the conduct engaged in by the defendant:
4848 (1) was intended to warn a person operating a motor
4949 vehicle of the presence of a peace officer who was enforcing
5050 Subtitle C, Title 7, Transportation Code; or
5151 (2) consisted only of filming, recording,
5252 photographing, documenting, or observing a peace officer.
5353 SECTION 4. Section 542.501, Transportation Code, is amended
5454 to read as follows:
5555 Sec. 542.501. OBEDIENCE REQUIRED TO PEACE [POLICE] OFFICERS
5656 AND TO SCHOOL CROSSING GUARDS. (a) A person may not wilfully fail
5757 or refuse to comply with a lawful order or direction of:
5858 (1) a peace [police] officer; or
5959 (2) a school crossing guard who:
6060 (A) is performing crossing guard duties in a
6161 school crosswalk to stop and yield to a pedestrian; or
6262 (B) has been trained under Section 600.004 and is
6363 directing traffic in a school crossing zone.
6464 (b) Subsection (a)(1) does not apply to an order or
6565 direction to cease filming, recording, photographing, documenting,
6666 or observing a peace officer while the officer is engaged in the
6767 performance of official duties.
6868 SECTION 5. Chapter 112, Civil Practice and Remedies Code,
6969 as added by this Act, applies only with respect to a prosecution of
7070 an offense committed on or after the effective date of this Act.
7171 SECTION 6. (a) Except as provided by Subsection (b) of this
7272 section, Sections 22.01 and 38.15, Penal Code, and Section 542.501,
7373 Transportation Code, as amended by this Act, apply to the
7474 prosecution of an offense under one of those sections commenced
7575 before, on, or after the effective date of this Act.
7676 (b) A final conviction for an offense under Section 22.01 or
7777 38.15, Penal Code, or Section 542.501, Transportation Code, that
7878 exists on the effective date of this Act is unaffected by this Act.
7979 SECTION 7. This Act takes effect September 1, 2015.
