115 A BILL TO BE ENTITLED
126 AN ACT
137 relating to the savings incentive program for state agencies.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 2108.103, Government Code, is amended by
16- amending Subsection (a) and adding Subsections (c), (d), and (e) to
17- read as follows:

1812 (a) The affected agency retains one-half [one- fourth] of
1913 the amount of savings verified by the comptroller[, not to exceed
2014 one percent of the amount of undedicated general revenue derived
2115 from nonfederal sources appropriated to the agency for the fiscal
2216 year in which the savings are realized].
2317 (c) Of the savings retained by the agency, one-half:
2418 (1) must be used to make additional principal payments
2519 for general obligation bonds issued by the agency or on behalf of
2620 the agency by the Texas Public Finance Authority; or
2721 (2) if there are no outstanding general obligation
2822 bonds issued by the agency or on behalf of the agency by the Texas
2923 Public Finance Authority, may be used to provide bonuses,
3024 distributed equally, to each agency employee who:
3125 (A) is a current full-time equivalent employee of
3226 the agency;
3327 (B) worked for the agency as a full-time
3428 equivalent employee for the entire fiscal year in which the savings
3529 were realized; and
3630 (C) is directly responsible for or worked in a
3731 department, office, or other division within the agency that is
3832 responsible for the savings realized.
3933 (d) If the amount of agency savings verified under Section
4034 2108.102, expressed as a percentage of the total amount of
4135 undedicated general revenue derived from nonfederal sources
4236 appropriated to the agency for the fiscal year in which the savings
4337 were realized, is:
4438 (1) less than three percent, a bonus described by
4539 Subsection (c)(2) may not exceed $250;
4640 (2) at least three percent but less than five percent,
4741 a bonus described by Subsection (c)(2) may not exceed $500;
4842 (3) at least five percent but less than 10 percent, a
4943 bonus described by Subsection (c)(2) may not exceed $750; and
5044 (4) 10 percent or more, a bonus described by
5145 Subsection (c)(2) may not exceed $1,000.
52- (e) A state agency shall adopt rules to implement this
46+ (e) A state agency may not provide a bonus under Subsection
47+ (c)(2) to an employee of the agency who serves in an upper
48+ management position, including the chief executive or chief
49+ administrator of the agency.
50+ (f) A state agency shall adopt rules to implement this

5452 SECTION 2. This Act applies to notice under Section
5553 2108.101, Government Code, of savings from appropriations to a
5654 state agency for a state fiscal year beginning on or after September
5755 1, 2015.
5856 SECTION 3. This Act takes effect September 1, 2015.
