11 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 8 | | SECTION 1. Section 372.0035(a), Local Government Code, is |
---|
13 | 9 | | amended to read as follows: |
---|
14 | 10 | | (a) This section applies only to: |
---|
15 | 11 | | (1) a municipality that: |
---|
16 | 12 | | (A) has a population of more than 650,000 and |
---|
17 | 13 | | less [one million and a council-manager form of government and that |
---|
18 | 14 | | is located wholly or partly in a county with a population of more] |
---|
19 | 15 | | than two million; or |
---|
20 | 16 | | (B) has a population of more than 325,000 and |
---|
21 | 17 | | less than 625,000; and |
---|
22 | 18 | | (2) a public improvement district established under |
---|
23 | 19 | | this subchapter and solely composed of territory in which the only |
---|
24 | 20 | | businesses are: |
---|
25 | 21 | | (A) hotels with 100 or more rooms ordinarily used |
---|
26 | 22 | | for sleeping, if the district is established by a municipality |
---|
27 | 23 | | described by Subdivision (1)(A); or |
---|
28 | 24 | | (B) hotels with 75 or more rooms ordinarily used |
---|
29 | 25 | | for sleeping, if the district is established by a municipality |
---|
30 | 26 | | described by Subdivision (1)(B). |
---|
31 | 27 | | SECTION 2. Section 372.005, Local Government Code, is |
---|
32 | 28 | | amended by adding Subsection (b-1) to read as follows: |
---|
33 | 29 | | (b-1) Notwithstanding Subsection (b), a petition for the |
---|
34 | 30 | | establishment of a public improvement district described by Section |
---|
35 | 31 | | 372.0035(a)(2) is sufficient only if signed by record owners of |
---|
36 | 32 | | taxable real property liable for assessment under the proposal who |
---|
37 | 33 | | constitute: |
---|
38 | 34 | | (1) more than 60 percent of the appraised value of |
---|
39 | 35 | | taxable real property liable for assessment under the proposal, as |
---|
40 | 36 | | determined by the current roll of the appraisal district in which |
---|
41 | 37 | | the property is located; and |
---|
42 | 38 | | (2) more than 60 percent of: |
---|
43 | 39 | | (A) all record owners of taxable real property |
---|
44 | 40 | | that are liable for assessment under the proposal; or |
---|
45 | 41 | | (B) the area of all taxable real property that is |
---|
46 | 42 | | liable for assessment under the proposal. |
---|
47 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
---|
48 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 47 | | Act takes effect September 1, 2015. |
