84 AN ACT
95 relating to a common characteristic or use project in a public
106 improvement district in certain municipalities.
117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
128 SECTION 1. Section 372.0035(a), Local Government Code, is
139 amended to read as follows:
1410 (a) This section applies only to:
1511 (1) a municipality that:
1612 (A) has a population of more than 650,000 and
1713 less [one million and a council-manager form of government and that
1814 is located wholly or partly in a county with a population of more]
1915 than two million; or
2016 (B) has a population of more than 325,000 and
2117 less than 625,000; and
2218 (2) a public improvement district established under
2319 this subchapter and solely composed of territory in which the only
2420 businesses are:
2521 (A) hotels with 100 or more rooms ordinarily used
2622 for sleeping, if the district is established by a municipality
2723 described by Subdivision (1)(A); or
2824 (B) hotels with 75 or more rooms ordinarily used
2925 for sleeping, if the district is established by a municipality
3026 described by Subdivision (1)(B).
3127 SECTION 2. Section 372.005, Local Government Code, is
3228 amended by adding Subsection (b-1) to read as follows:
3329 (b-1) Notwithstanding Subsection (b), a petition for the
3430 establishment of a public improvement district described by Section
3531 372.0035(a)(2) is sufficient only if signed by record owners of
3632 taxable real property liable for assessment under the proposal who
3733 constitute:
3834 (1) more than 60 percent of the appraised value of
3935 taxable real property liable for assessment under the proposal, as
4036 determined by the current roll of the appraisal district in which
4137 the property is located; and
4238 (2) more than 60 percent of:
4339 (A) all record owners of taxable real property
4440 that are liable for assessment under the proposal; or
4541 (B) the area of all taxable real property that is
4642 liable for assessment under the proposal.
4743 SECTION 3. This Act takes effect immediately if it receives
4844 a vote of two-thirds of all the members elected to each house, as
4945 provided by Section 39, Article III, Texas Constitution. If this
5046 Act does not receive the vote necessary for immediate effect, this
5147 Act takes effect September 1, 2015.
