| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Subchapter E, Chapter 437, Government Code, is |

| 11 | 9 | | amended by adding Section 437.2235 to read as follows: |

| 12 | 10 | | Sec. 437.2235. PUBLIC DUTY JUSTIFICATION. Section 9.21, |
|---|
| 13 | 11 | | Penal Code, applies to conduct of a service member of the Texas |
|---|
| 14 | 12 | | military forces ordered into service of this state by proper |
|---|
| 15 | 13 | | authority that is performed in the service member's official |
|---|
| 16 | 14 | | capacity. |
|---|
| 17 | 15 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 18 | 16 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 19 | 17 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 20 | 18 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 21 | 19 | | Act takes effect September 1, 2015. |
