115 AN ACT
126 relating to public school teacher performance appraisals,
137 continuing education, professional development, career
148 advancement, and compensation.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Subchapter A, Chapter 21, Education Code, is
1711 amended by adding Section 21.009 to read as follows:
1812 Sec. 21.009. TEACHER DEVELOPMENT FRAMEWORK. (a) The
19- commissioner by rule shall adopt a teacher development framework to
20- be used by a school district in making decisions regarding
13+ commissioner by rule shall adopt a teacher development framework
14+ that may be used by a school district in making decisions regarding
2115 teachers, including decisions related to:
2216 (1) appraisals of performance;
2317 (2) professional development opportunities;
2418 (3) career advancement; and
2519 (4) compensation.
2620 (b) The teacher development framework must require that
2721 decisions regarding a teacher's professional development
2822 opportunities, career advancement, and compensation include the
2923 teacher's appraisal as a substantial factor. Decisions regarding
3024 career advancement for a teacher must be based on consecutive
3125 appraisals of the teacher from at least two consecutive years, if
3226 available.
3327 (c) The commissioner shall appoint a committee composed of
3428 educators and other stakeholders to assist the commissioner in
3529 reviewing and revising the teacher development framework at least
3630 once every five years.
3731 SECTION 2. Section 21.054, Education Code, is amended by
3832 amending Subsection (a) and adding Subsections (a-1) and (d-1) to
3933 read as follows:
4034 (a) The board shall propose rules establishing processes [a
4135 process] for:
4236 (1) identifying continuing education courses and
4337 programs that fulfill educators' continuing education
4438 requirements; and
4539 (2) enabling an educator to provide feedback to the
4640 board regarding a course or program completed by the educator.
4741 (a-1) The feedback received by the board regarding a
4842 continuing education course or program completed by an educator
4943 must be accessible to the public.
5044 (d-1) Continuing education requirements for a classroom
5145 teacher must provide that a significant percentage of the training
5246 required every five years includes instruction designed to advance
5347 any knowledge and skill identified in the teacher's appraisal as
5448 needing improvement.
5549 SECTION 3. Section 21.203(a), Education Code, is amended to
5650 read as follows:
5751 (a) The [Except as provided by Section 21.352(c), the]
5852 employment policies adopted by a board of trustees must require a
5953 written evaluation of each teacher at annual or more frequent
6054 intervals. The policies adopted by the board may include the use of
6155 peer-to-peer review and other measures involving the participation
6256 of teachers in the evaluation process. The board must consider the
6357 most recent evaluations before making a decision not to renew a
6458 teacher's contract if the evaluations are relevant to the reason
6559 for the board's action.
6660 SECTION 4. Section 21.351, Education Code, is amended by
6761 amending Subsections (a), (b), and (d) and adding Subsection (a-1)
6862 to read as follows:
6963 (a) The commissioner shall adopt a recommended appraisal
7064 process and criteria on which to appraise the performance of
7165 teachers. The criteria must be based on measures of a teacher's
7266 performance [observable, job-related behavior], including:
7367 (1) the teacher's [teachers'] implementation of
7468 discipline management procedures; [and]
7569 (2) the academic performance of the teacher's
7670 students;
7771 (3) teaching standards that articulate expected
7872 teacher knowledge, understanding, skill, and practice to ensure
7973 student educational growth in academics;
8074 (4) classroom observations; and
8175 (5) data related to the teacher's efforts, both
8276 individually and as part of collaborative settings, to improve the
8377 teacher's professional performance, as evident in the teacher's
8478 level of professional engagement and growth [the performance of
8579 teachers' students].
8680 (a-1) In adopting criteria relating to the academic
8781 performance of a teacher's students as required by Subsection
8882 (a)(2), the commissioner shall include measures of student
8983 educational growth based on academics. The measures of student
9084 educational growth adopted by the commissioner under this
9185 subsection may not be limited to examining the performance of the
9286 teacher's students on assessment instruments required under
9387 Section 39.023 but must include other measures of student
9488 educational growth.
9589 (b) The commissioner shall solicit and consider the advice
9690 of teachers and other stakeholders in developing the recommended
9791 appraisal process and performance criteria.
9892 (d) Under the recommended appraisal process, appraisal for
9993 teachers must be detailed by category of professional skill and
10094 characteristic and must provide for separate ratings for each
10195 category. The appraisal process shall guarantee a conference
10296 between the teacher and the appraiser. The conference shall be
10397 diagnostic and prescriptive with regard to improvement and
10498 professional development [remediation] needed in overall
10599 performance and by category.
106- SECTION 5. Sections 21.352(a) and (c), Education Code, are
107- amended to read as follows:

108103 (a) In appraising teachers, each school district shall use:
109104 (1) the appraisal process and performance criteria

111106 (A) the teacher development framework described
112107 by Section 21.009; and
113108 (B) the measures described by Section 21.351(a);

115- (2) an appraisal process and performance criteria[:
116- [(A) developed by the district- and campus-level

111+ (A) developed by the district- and campus-level
117112 committees established under Section 11.251;
118- [(B)] containing the items described by Section

115+ (C) adopted by the board of trustees.
121116 (c) Appraisal [Except as otherwise provided by this
122117 subsection, appraisal] must be done at least once during each
123118 school year. [A teacher may be appraised less frequently if the
124119 teacher agrees in writing and the teacher's most recent evaluation
125120 rated the teacher as at least proficient, or the equivalent, and did
126121 not identify any area of deficiency. A teacher who is appraised
127122 less frequently than annually must be appraised at least once
128123 during each period of five school years.] The district shall
129124 maintain a [written] copy of the evaluation of each teacher's
130125 performance in the teacher's personnel file. Each teacher is
131126 entitled to receive a written or electronic copy of the evaluation
132127 promptly on its completion. After receiving a [written] copy of the
133128 evaluation, a teacher is entitled to a second appraisal by a
134129 different appraiser or to submit a written rebuttal to the
135130 evaluation to be attached to the evaluation in the teacher's
136131 personnel file. The evaluation and any rebuttal may be given to
137132 another school district at which the teacher has applied for
138133 employment at the request of that district.
134+ (g) The commissioner shall develop a training course to
135+ assist and provide support to school administrators in successfully
136+ implementing teacher appraisal processes under this section.
139137 SECTION 6. The heading to Section 21.402, Education Code,
140138 is amended to read as follows:
141139 Sec. 21.402. MINIMUM SALARY [SCHEDULE] FOR CERTAIN
142140 PROFESSIONAL STAFF.
143141 SECTION 7. Section 21.402(a), Education Code, as effective
144142 until September 1, 2017, is amended to read as follows:
145143 (a) Except as provided by Subsection (f), a school district
146144 must pay each [classroom teacher,] full-time librarian, full-time
147145 school counselor certified under Subchapter B, or full-time school
148146 nurse not less than the minimum monthly salary, based on the
149147 employee's level of experience in addition to other factors, as
150148 determined by commissioner rule, determined by the following
151149 formula:
152150 MS = SF x FS
153151 where:
154152 "MS" is the minimum monthly salary;
155153 "SF" is the applicable salary factor specified by
156154 Subsection (c); and
157155 "FS" is the amount, as determined by the commissioner
158156 under Subsection (b), of the basic allotment as provided by Section
159157 42.101(a) or (b) for a school district with a maintenance and
160158 operations tax rate at least equal to the state maximum compressed
161159 tax rate, as defined by Section 42.101(a).
162160 SECTION 8. Section 21.402(a), Education Code, as effective
163161 September 1, 2017, is amended to read as follows:
164162 (a) Except as provided by Subsection (e-1) or (f), a school
165163 district must pay each [classroom teacher,] full-time librarian,
166164 full-time school counselor certified under Subchapter B, or
167165 full-time school nurse not less than the minimum monthly salary,
168166 based on the employee's level of experience in addition to other
169167 factors, as determined by commissioner rule, determined by the
170168 following formula:
171169 MS = SF x FS
172170 where:
173171 "MS" is the minimum monthly salary;
174172 "SF" is the applicable salary factor specified by
175173 Subsection (c); and
176174 "FS" is the amount, as determined by the commissioner
177175 under Subsection (b), of the basic allotment as provided by Section
178176 42.101(a) or (b) for a school district with a maintenance and
179177 operations tax rate at least equal to the state maximum compressed
180178 tax rate, as defined by Section 42.101(a).
181179 SECTION 9. Section 21.402, Education Code, is amended by
182180 adding Subsection (a-1) and amending Subsections (c-1), (f), and
183181 (h) to read as follows:
184182 (a-1) Each school district shall pay a minimum monthly
185183 salary to each classroom teacher that is not less than $2,754. A
186- district may pay a higher monthly salary based on criteria that are
187- not inconsistent with the teacher development framework adopted by
188- the commissioner under Section 21.009.
184+ district may pay a higher monthly salary after considering criteria
185+ included in the teacher development framework adopted by the
186+ commissioner under Section 21.009 or included in a locally
187+ developed framework.
189188 (c-1) Notwithstanding Subsections (a) and (b), each school
190189 district shall pay a monthly salary to each [classroom teacher,]
191190 full-time speech pathologist, full-time librarian, full-time
192191 school counselor certified under Subchapter B, and full-time school
193192 nurse that is at least equal to the following monthly salary or the
194193 monthly salary determined by the commissioner under Subsections (a)

242241 (f) Notwithstanding Subsection (a), a [teacher or]
243242 librarian who received a career ladder supplement on August 31,
244243 1993, is entitled to at least the same gross monthly salary the
245244 [teacher or] librarian received for the 1994-1995 school year as
246245 long as the [teacher or] librarian is employed by the same district.
247246 (h) In this section, "gross monthly salary" must include the
248247 amount a [teacher or] librarian received that represented a career
249248 ladder salary supplement under Section 16.057, as that section
250249 existed January 1, 1993.
251250 SECTION 10. Sections 21.403(a), (c), and (d), Education
252251 Code, are amended to read as follows:
253252 (a) A [teacher,] librarian, school counselor, or nurse
254253 shall advance one step on the minimum salary schedule under Section
255254 21.402 for each year of experience as a [teacher,] librarian,
256255 school counselor, or nurse until step 20 is reached.
257256 (c) The commissioner shall adopt rules for determining the
258257 experience for which a [teacher,] librarian, school counselor, or
259258 nurse is to be given credit in placing the [teacher,] librarian,
260259 school counselor, or nurse on the minimum salary schedule. A
261260 district shall credit the [teacher,] librarian, school counselor,
262261 or nurse for each year of experience without regard to whether the
263262 years are consecutive.
264263 (d) As long as a [teacher or] librarian who received a
265264 career ladder supplement is employed by the same school district,
266265 the [teacher or] librarian is entitled to:
267266 (1) placement on the minimum salary schedule at the
268267 step above the step on which the librarian [teacher] would
269268 otherwise be placed, if the [teacher or] librarian received a
270269 career ladder supplement for level two of the career ladder on
271270 August 31, 1993; or
272271 (2) placement on the minimum salary schedule at the
273272 step two steps above the step on which the librarian [teacher] would
274273 otherwise be placed, if the [teacher or] librarian received a
275274 career ladder supplement for level three of the career ladder on
276275 August 31, 1993.
277276 SECTION 11. Section 21.4031(a)(2), Education Code, is
278277 amended to read as follows:
279278 (2) "Service record" means a school district document
280279 that indicates the total years of service provided to the district
281280 by a [classroom teacher,] librarian, school counselor, or nurse.
282281 SECTION 12. Section 21.4031(b), Education Code, is amended
283282 to read as follows:
284283 (b) On request by a [classroom teacher,] librarian, school
285284 counselor, or nurse or by the school district employing one of those
286285 individuals, a school district that previously employed the
287286 individual shall provide a copy of the individual's service record
288287 to the school district employing the individual. The district must
289288 provide the copy not later than the 30th day after the later of:
290289 (1) the date the request is made; or
291290 (2) the date of the last day of the individual's
292291 service to the district.
293292 SECTION 13. The heading to Subchapter J, Chapter 21,
294293 Education Code, is amended to read as follows:
295294 SUBCHAPTER J. EDUCATOR PROFESSIONAL [STAFF] DEVELOPMENT AND
296295 TRAINING
297296 SECTION 14. The heading to Section 21.451, Education Code,
298297 is amended to read as follows:
299298 Sec. 21.451. EDUCATOR PROFESSIONAL [STAFF] DEVELOPMENT AND
300299 TRAINING REQUIREMENTS.
301300 SECTION 15. Sections 21.451(a), (b), (c), (d), and (g),
302301 Education Code, are amended to read as follows:
303302 (a) The professional [staff] development opportunities, not
304303 including the training described by Subsection (c), provided by a
305304 school district to an educator other than a principal must [be]:
306305 (1) be designed to increase the effectiveness of
307306 classroom instruction and improve student achievement;
308307 (2) be conducted in accordance with standards
309308 developed by the district;
310309 (3) enable an educator to advance knowledge and skills
311310 identified as needing improvement in the educator's appraisal;
312311 (4) include a range of instructional formats,
313312 including intensive and sustained in-class coaching, collaborative
314313 learning, and blended learning;
315314 (5) enable an educator to select the content and
316315 format of the educator's professional development opportunities;
317316 and
318317 (6) be [(2)] designed to improve education in the
319318 district.
320319 (b) The professional [staff] development described by
321320 Subsection (a) must include opportunities that address:
322321 (1) [be predominantly] campus-based performance
323322 objectives; and
324323 (2) performance objectives of individual educators
325324 established as part of educator appraisals[, related to achieving
326325 campus performance objectives established under Section 11.253,
327326 and developed and approved by the campus-level committee
328327 established under Section 11.251].
329328 (c) For professional [staff] development under Subsection
330329 (a), a school district may use district-wide training [staff
331330 development] developed and approved through the district-level
332331 decision process under Section 11.251, provided that training
333332 developed under this subsection does not represent the majority of
334333 the district's professional development opportunities.
335334 (d) The training described by Subsection (c) [staff
336335 development]:
337336 (1) may include training in:
338337 (A) technology;
339338 (B) conflict resolution;
340339 (C) discipline strategies, including classroom
341340 management, district discipline policies, and the student code of
342341 conduct adopted under Section 37.001, and Chapter 37; and
343342 (D) preventing, identifying, responding to, and
344343 reporting incidents of bullying; and
345344 (2) subject to Subsection (e) and to Section 21.3541
346345 and rules adopted under that section, must include training based
347346 on scientifically based research, as defined by Section 9101, No
348347 Child Left Behind Act of 2001 (20 U.S.C. Section 7801), that:
349348 (A) relates to instruction of students with
350349 disabilities; and
351350 (B) is designed for educators who work primarily
352351 outside the area of special education.
353352 (g) The professional [staff] development may include
354353 instruction as to what is permissible under law, including opinions
355354 of the United States Supreme Court, regarding prayer in public
356355 school.
357356 SECTION 16. Sections 21.4511(a) and (b), Education Code,
358357 are amended to read as follows:
359358 (a) From funds appropriated for that purpose in an amount
360359 not to exceed $2.5 million each year, the commissioner may develop
361360 and award grants to school districts, regional education service
362361 centers, nonprofit organizations, and institutions of higher
363362 education for establishing and providing technical assistance and
364363 professional development activities in the professional [staff]
365364 development [training] of public school teachers and
366365 administrators.
367366 (b) The professional development [training] under this
368367 section shall include professional development [training] relating
369368 to implementing curriculum and instruction that is aligned with the
370369 foundation curriculum described by Section 28.002(a)(1) and
371370 standards and expectations for college readiness, as determined by
372371 State Board of Education rule under Section 28.008(d).
373372 SECTION 17. The heading to Section 21.453, Education Code,
374373 is amended to read as follows:
375374 Sec. 21.453. PROFESSIONAL [STAFF] DEVELOPMENT ACCOUNT.
376375 SECTION 18. Sections 21.453(a) and (b), Education Code, are
377376 amended to read as follows:
378377 (a) The professional [staff] development account is an
379378 account in the general revenue fund. The account consists of gifts,
380379 grants, donations, appropriations for the purpose of professional
381380 [staff] development under this subchapter, and any other money
382381 transferred by law to the account. Funds in the account may be used
383382 only as provided by this section.
384383 (b) The commissioner may allocate funds from the account to
385384 regional education service centers to provide professional [staff]
386385 development resources to school districts that:
387386 (1) are rated academically unacceptable;
388387 (2) have one or more campuses rated as academically
389388 unacceptable; or
390389 (3) are otherwise in need of assistance as indicated
391390 by the academic performance of students, as determined by the
392391 commissioner.
393- SECTION 19. Section 21.7061(a), Education Code, is amended
394- to read as follows:
395- (a) Notwithstanding any other provision of this code and
396- subject to Subsection (b), a school district may apply to the
397- commissioner in writing in accordance with commissioner rule for a
398- waiver to exempt the district or one or more district campuses from
399- Section 21.352(a)(2) [21.352(a)(2)(B)], 21.353, 21.354(d),
400- 21.3541(g), 21.451, or 21.458, as specified in the waiver
401- application. The district's application for a waiver under this
402- section must demonstrate that the waiver is necessary to carry out
403- purposes of the program as described by Section 21.7011, in
404- accordance with the district's local educator excellence
405- innovation plan.
406- SECTION 20. Section 22.107(a), Education Code, is amended

408394 (a) A school district shall pay each full-time district
409395 employee, other than an administrator or an employee entitled
410396 [subject] to a [the] minimum salary [schedule] under Section
411397 21.402, an amount at least equal to $500.
398+ SECTION 20. Sections 28.053(a), (d), and (e), Education
399+ Code, are amended to read as follows:
400+ (a) A school participating in the program may be awarded[:
401+ [(1)] a one-time $3,000 equipment grant for providing
402+ a college advanced placement course or international baccalaureate
403+ course to be paid to a school based on need as determined by the
404+ commissioner[; and
405+ [(2) $100 for each student who scores a three or better
406+ on a college advanced placement test or four or better on an
407+ international baccalaureate examination].
408+ (d) A teacher participating in the program may be awarded:
409+ (1) subsidized teacher training, not to exceed $450
410+ for each teacher, for a college advanced placement course or an
411+ international baccalaureate course; and
412+ (2) $50 for each student enrolled in the teacher's
413+ college advanced placement or international baccalaureate course
414+ who scores a three or better on the college advanced placement test
415+ or four or better on the international baccalaureate examination,
416+ as applicable, not to exceed a total amount of $2,000 each year [a
417+ one-time award of $250 for teaching a college advanced placement
418+ course or an international baccalaureate course for the first time;
419+ and
420+ [(3) a share of the teacher bonus pool, which shall be
421+ distributed by the teacher's school in shares proportional to the
422+ number of courses taught].
423+ (e) To be eligible for an award under Subsection (d)(2)
424+ [(d)], a teacher must teach a college advanced placement course or
425+ an international baccalaureate course at a school with a student
426+ enrollment in which at least 50 percent of the students are
427+ educationally disadvantaged.
412428 SECTION 21. Section 38.0041(f), Education Code, is amended
413429 to read as follows:
414430 (f) The training under Subsection (c) may be included in
415431 professional [staff] development and training under Section
416432 21.451.
417433 SECTION 22. Section 42.2513(a), Education Code, is amended
418434 to read as follows:
419435 (a) A school district, including a school district that is
420436 otherwise ineligible for state aid under this chapter, is entitled
421437 to state aid in an amount equal to the sum of:
422438 (1) the product of $500 multiplied by the number of
423439 full-time district employees, other than administrators or
424440 employees entitled [subject] to a [the] minimum salary [schedule]
425441 under Section 21.402; and
426442 (2) the product of $250 multiplied by the number of
427443 part-time district employees, other than administrators.
428444 SECTION 23. Section 823.404(a), Government Code, is amended
429445 to read as follows:
430446 (a) An eligible member may establish one year of equivalent
431447 membership service credit for each year [one or two years] of work
432448 experience that was required for the member's certification under
433449 Chapter 21, Education Code, in a career or technological field for a
434450 maximum of two years [for which the member is entitled to salary
435451 step credit under Section 21.403(b), Education Code].
436452 SECTION 24. Subchapter E, Chapter 825, Government Code, is
437453 amended by adding Section 825.4051 to read as follows:
438454 Sec. 825.4051. MAINTENANCE OF STATE CONTRIBUTION. (a) The
439455 board of trustees shall adopt and maintain a schedule based on the
440456 minimum salary schedule for certain professional staff under
441457 Section 21.402(c-1), Education Code, as that subsection existed on
442458 January 1, 2015, for the purposes of calculating the required state
443459 contribution for retirement benefits for classroom teachers under
444460 this subtitle.
445461 (b) The board of trustees may adopt rules to implement this
446462 section.
447- SECTION 25. Sections 21.352(b) and 21.403(b), Education
448- Code, are repealed.
449- SECTION 26. This Act applies beginning with the 2016-2017
450- school year.
463+ SECTION 25. (a) Sections 21.352(b) and 28.053(b), (c),
464+ (f), and (g), Education Code, are repealed.
465+ (b) Effective September 1, 2016, Section 21.403(b),
466+ Education Code, is repealed.
467+ SECTION 26. (a) Except as provided by Subsection (b) of
468+ this section, this Act applies beginning with the 2016-2017 school
469+ year.
470+ (b) Section 28.053, Education Code, as amended by this Act,
471+ applies beginning with the 2015-2016 school year.
451472 SECTION 27. (a) Sections 21.402, 21.403, 21.4031, and
452473 42.2513, Education Code, as amended by this Act, take effect
453474 September 1, 2016.
454475 (b) Section 823.404(a), Government Code, as amended by this
455476 Act, and Section 825.4051, Government Code, as added by this Act,
456477 take effect September 1, 2016.
457- (c) Except as provided by Subsections (a) and (b) of this
458- section, this Act takes effect immediately if it receives a vote of
459- two-thirds of all the members elected to each house, as provided by
460- Section 39, Article III, Texas Constitution. If this Act does not
461- receive the vote necessary for immediate effect, this Act takes
462- effect September 1, 2015.

479+ effect immediately if it receives a vote of two-thirds of all the
480+ members elected to each house, as provided by Section 39, Article
