| 15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Section 84.002(a), Local Government Code, is |
|---|
| 17 | 17 | | amended to read as follows: |

| 18 | 18 | | (a) Except as provided by Subsection (b) or Section 84.0035 |
|---|
| 19 | 19 | | [In a county with a population of 10,200 or more], the district |
|---|
| 20 | 20 | | judges shall appoint a county auditor. |
|---|
| 21 | 21 | | SECTION 2. Subchapter A, Chapter 84, Local Government Code, |
|---|
| 22 | 22 | | is amended by adding Section 84.0035 to read as follows: |

| 23 | 23 | | Sec. 84.0035. PROCEDURE FOR APPOINTMENT IN CERTAIN |
|---|
| 24 | 24 | | COUNTIES. (a) In a county with a population of more than 300,000 |
|---|
| 25 | 25 | | but less than 800,000 that borders the Rio Grande, the district |
|---|
| 26 | 26 | | judges, one county commissioner, and the county judge shall hold a |
|---|
| 27 | 27 | | meeting for the purpose of appointing a county auditor. |
|---|
| 28 | 28 | | (b) The commissioners court shall designate one of its |
|---|
| 29 | 29 | | county commissioners to attend the meeting to appoint the county |
|---|
| 30 | 30 | | auditor. |
|---|
| 31 | 31 | | (c) For a county auditor to be appointed, a majority of the |
|---|
| 32 | 32 | | district judges, the designated county commissioner, and the county |
|---|
| 33 | 33 | | judge must be present at the meeting. A candidate for the office |
|---|
| 34 | 34 | | must receive at least a majority vote of the district judges and |
|---|
| 35 | 35 | | members of the commissioners court who are present and voting at the |
|---|
| 36 | 36 | | meeting. |
|---|
| 37 | 37 | | (d) Each district judge may nominate any number of |
|---|
| 38 | 38 | | candidates for the office. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2015. |
