55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the suspension of a driver's license for failure to pay
88 a surcharge.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 708.151(c), Transportation Code, is
1111 amended to read as follows:
1212 (c) If on or before the 45th day after the date the first
1313 notice was sent the person fails to pay the amount of the surcharge
1414 or fails to enter into an installment payment agreement with the
1515 department, the department shall send a second notice. [If on or
1616 before the 60th day after the date the second notice was sent the
1717 person fails to pay the amount of the surcharge or fails to enter
1818 into an installment payment agreement with the department, the
1919 department shall send a third notice that advises the person that
2020 the person's driving privileges are suspended.]
2121 SECTION 2. Section 708.154, Transportation Code, is amended
2222 to read as follows:
2323 Sec. 708.154. CREDIT CARD PAYMENT OF SURCHARGE. [(a)] The
2424 department by rule may authorize the payment of a surcharge by use
2525 of a credit card. The rules shall require the person to pay all
2626 costs incurred by the department in connection with the acceptance
2727 of the credit card.
2828 [(b) If a surcharge or a related cost is paid by credit card
2929 and the amount is subsequently reversed by the issuer of the credit
3030 card, the license of the person is automatically suspended.
3131 [(c) A license suspended under this section remains
3232 suspended until the person pays the amount of the surcharge and any
3333 related costs.]
3434 SECTION 3. Section 708.152, Transportation Code, is
3535 repealed.
3636 SECTION 4. This Act takes effect September 1, 2015.
