64 AN ACT
75 relating to the authority of the Public Utility Commission of Texas
86 to retain assistance for federal proceedings affecting certain
97 electric utilities and consumers.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Subchapter I, Chapter 39, Utilities Code, is
1210 amended by adding Section 39.408 to read as follows:
1311 Sec. 39.408. HIRING ASSISTANCE FOR FEDERAL PROCEEDINGS.
1412 (a) The commission may retain any consultant, accountant,
1513 auditor, engineer, or attorney the commission considers necessary
1614 to represent the commission in a proceeding before the Federal
1715 Energy Regulatory Commission, or before a court reviewing
1816 proceedings of that federal commission, related to:
1917 (1) the relationship of an electric utility subject to
2018 this subchapter to a power region, regional transmission
2119 organization, or independent system operator;
2220 (2) the approval of an agreement among the electric
2321 utility and the electric utility's affiliates concerning the
2422 coordination of the operations of the electric utility and the
2523 electric utility's affiliates; or
2624 (3) other matters related to the electric utility
2725 subject to this subchapter that may affect the ultimate rates paid
2826 by retail customers in this state.
2927 (b) Assistance for which a consultant, accountant, auditor,
3028 engineer, or attorney may be retained under Subsection (a) may
3129 include:
3230 (1) conducting a study;
3331 (2) conducting an investigation;
3432 (3) presenting evidence;
3533 (4) advising the commission; or
3634 (5) representing the commission.
3735 (c) The electric utility shall pay timely the reasonable
3836 costs of the services of a person retained under Subsection (a), as
3937 determined by the commission. The total costs an electric utility
4038 is required to pay under this subsection may not exceed $1.5 million
4139 in a 12-month period.
4240 (d) The commission shall allow the electric utility to
4341 recover both the total costs the electric utility paid under
4442 Subsection (c) and the carrying charges for those costs through a
4543 rider established annually to recover the costs paid and carrying
4644 charges incurred during the preceding calendar year. The rider may
4745 not be implemented before the rider is reviewed and approved by the
4846 commission.
4947 (e) The commission shall consult the attorney general
5048 before the commission retains a consultant, accountant, auditor, or
5149 engineer under Subsection (a). The retention of an attorney under
5250 Subsection (a) is subject to the approval of the attorney general
5351 under Section 402.0212, Government Code.
5452 (f) The commission shall be precluded from engaging any
5553 individual who is required to register under Section 305.003,
5654 Government Code.
5755 (g) This section expires September 1, 2023.
5856 SECTION 2. Section 39.4525, Utilities Code, is amended by
5957 amending Subsections (a) and (g) to read as follows:
6058 (a) The commission may retain any consultant, accountant,
6159 auditor, engineer, or attorney the commission considers necessary
6260 to represent the commission in a proceeding before the Federal
6361 Energy Regulatory Commission, or before a court reviewing
6462 proceedings of that federal commission, related to:
6563 (1) the relationship of an electric utility subject to
6664 this subchapter to a power region, regional transmission
6765 organization, or independent system operator; [or]
6866 (2) the approval of an agreement among the electric
6967 utility and the electric utility's affiliates concerning the
7068 coordination of the operations of the electric utility and the
7169 electric utility's affiliates; or
7270 (3) other matters related to the electric utility
7371 subject to this subchapter that may affect the ultimate rates paid
7472 by retail customers in this state.
7573 (g) This section expires September 1, 2023 [December 31,
7674 2017].
7775 SECTION 3. Subchapter K, Chapter 39, Utilities Code, is
7876 amended by adding Section 39.504 to read as follows:
7977 Sec. 39.504. HIRING ASSISTANCE FOR FEDERAL PROCEEDINGS.
8078 (a) The commission may retain any consultant, accountant,
8179 auditor, engineer, or attorney the commission considers necessary
8280 to represent the commission in a proceeding before the Federal
8381 Energy Regulatory Commission, or before a court reviewing
8482 proceedings of that federal commission, related to:
8583 (1) the relationship of an electric utility subject to
8684 this subchapter to a power region, regional transmission
8785 organization, or independent system operator;
8886 (2) the approval of an agreement among the electric
8987 utility and the electric utility's affiliates concerning the
9088 coordination of the operations of the electric utility and the
9189 electric utility's affiliates; or
9290 (3) other matters related to the electric utility
9391 subject to this subchapter that may affect the ultimate rates paid
9492 by retail customers in this state.
9593 (b) Assistance for which a consultant, accountant, auditor,
9694 engineer, or attorney may be retained under Subsection (a) may
9795 include:
9896 (1) conducting a study;
9997 (2) conducting an investigation;
10098 (3) presenting evidence;
10199 (4) advising the commission; or
102100 (5) representing the commission.
103101 (c) The electric utility shall pay timely the reasonable
104102 costs of the services of a person retained under Subsection (a), as
105103 determined by the commission. The total costs an electric utility
106104 is required to pay under this subsection may not exceed $1.5 million
107105 in a 12-month period.
108106 (d) The commission shall allow the electric utility to
109107 recover both the total costs the electric utility paid under
110108 Subsection (c) and the carrying charges for those costs through a
