55 CONCURRENT RESOLUTION
66 WHEREAS, Overreaching regulatory policies mandated by the
77 federal government encroach upon liberties guaranteed to United
88 States citizens by the First, Second, Fourth, and Fifth Amendments
99 enumerated in the Bill of Rights; and
1010 WHEREAS, In 2013, the U.S. House of Representatives passed
1111 with bipartisan support the Regulations From the Executive in Need
1212 of Scrutiny (REINS) Act, which requires that congressional approval
1313 be obtained prior to the execution of new major regulations; even if
1414 enacted, however, that law is vulnerable to repeal or waiver by a
1515 future Congress or president; and
1616 WHEREAS, States today have little recourse when the
1717 government in Washington, D.C., oversteps its authority; the only
1818 way to contest a federal regulation is to bring a constitutional
1919 challenge in federal court or to seek an amendment to the
2020 constitution; and
2121 WHEREAS, Passage of a regulation freedom amendment would help
2222 restore constitutional balance by providing that whenever
2323 one-fourth of the members of either the U.S. House of
2424 Representatives or the U.S. Senate transmit to the president of the
2525 United States a written declaration of opposition to a proposed
2626 federal regulation, the regulation would require a majority vote of
2727 approval from both chambers for adoption; and
2828 WHEREAS, A regulation freedom amendment would reestablish
2929 the separation of powers in the regulatory process and allow the
3030 will of the people to be voiced through their democratically
3131 elected representatives; now, therefore, be it
3232 RESOLVED, That the 84th Legislature of the State of Texas
3333 hereby respectfully urge the Congress of the United States to
3434 propose and submit to the states for ratification a regulation
3535 freedom amendment to the U.S. Constitution; and, be it further
3636 RESOLVED, That the Texas secretary of state forward official
3737 copies of this resolution to the president of the United States, to
3838 the speaker of the House of Representatives and to the president of
3939 the Senate of the United States Congress, and to all members of the
4040 Texas delegation to Congress with the request that this resolution
4141 be officially entered in the Congressional Record as a memorial to
4242 the Congress of the United States of America.
